STAFF REPORT
The Legislative Review Committee at their April 5, 1990
_eting, r~nded approval of the s_er capacity loan
praqraa. Thia pravr- permitted qualifYing City residents to
pey the sewer capacity fee as a loan over a 5 year period.
The loan proqraa was approved by the Kayar and Common Council
an 5/7/90. As an eleaent of this praqram, the Legislative
Revi_ Committee also re~nded that sot of the
installation casts which would be paid by a qualifying
property owner far connection of the sewer line from the
lateral to the property line be waiVed. This has been added
to the Municipal Code under Chapter 12.93.010(8).
Also included in the attached ordinance is one clean-up item.
This item incorporates an existing praqram which permits the
City to participate sot of the c~ts far repair of existing
sidewalk, curb and gutter under Chapter 12.93 of the Code.

12.93 TO THE SAN BERNARDINO MUNICIPAL CODE TO PROVIDE FOR CITY
3 PARTICIPATION IN SIDEWALK/CURB REPAIR AND CERTAIN SEWER
CONNECTION COSTS AND REPEALING SECTION 12.92.080.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:

SECTION 1:
Chapter 12.93 is hereby added to the
7 San Bernardino Municipal Code as follows:
8 "CITY PARTICIPATION IN SIDEWALK/CURB REPAIR
9 AND SEWER CONNECTION COSTS
10 12.93.010 Participation by City.

A.
Notwithstanding other provisions of this Code, the
12 Streets and Highways Code or any other provision of law, the
13 City, at its discretion, may contribute fifty per cent (50%) of
14 the costs to be paid by the property owner for repair of existing
15 sidewalk, curb, gutter or paved parkway improvements. The Public
16 Services Director shall determine when to contribute the fifty
17 percent (50%) based on the cost of the repair, the ability of
18 the property owner to pay, and the cooperation exhibited by the
19 property owner. Such determination shall be subject to appeal to
20 the Mayor and Common Council pursuant to Chapter 2.64 of this
21 code.

B.
Notwithstanding other provisions of this Code, the
23 Streets and Highway Code or any other provision of law, the City,
24 at its discretion, may waive fifty percent (50%) of the
25 installation costs to be paid by the property owner for
26 connection of the sewer line from the lateral to the property
27 line for an existing owner-occupied single family residence when
28 installed by the Public Services Department. The Public Services

Director shall determine when to waive the fifty percent (50%)
based on the cost of the installation, the ability of the
property owner to pay and the length of time the owners of the
property have paid a monthly sewer service charge. Such
determination shall be subject to appeal to the Mayor and Common
Council pursuant to Chapter 2.64 of this Code.
12.93.020 Administration.
The Director of Public Services may promulgate written
procedures, regulations, guidelines and fees pertaining to the
implementation of this chapter. Such procedures, regulations,
guidelines and fees shall not become effective until approved by
resolution by the Mayor and Common Council."
Section 2.
Section 12.92.080 of the San Bernardino
Municipal Code is hereby repealed.
