(Assessment District No. 994) Synopsis of Previous Council action: 11/02/89 01/06/90 Authorization to proceed continued to 1-8-90 for public hearing. Public hearing held and Authorization to Proceed referred to legislative Review Committee, and continued to 03-05-90. 01/22/90 --- Resolution No. 90-34 adopted authorizing agreement with GFB- Friederich & Assoc. for consultant services. 03/05/90 --- Authorization to Proceed was granted. 06/04/90 Resolution of Intention No. 90-207, was adopted, setting a public hearing date of June 27, 1990. Descri tion Assessment Council Notes: ~ CI.TY OF SAN BERNCRDINO - REQUEST ~R COUNCIL ACTION STAFF REPORT Assessment District No. 994 was proposed to generate funds to finance the costs included in the 1990/91 budget for street Lighting and Street Sweeping. The proposed budget for these services is $2,515,838. This amount, referred to as "Net Proceeds" in the Engineer's Report, would then be freed up in the general fund to be used for police services. Funds to finance an additional street sweeping per month, and the addition of approximately 200 street lights to the current system, is proposed to be added to the assessments. The amount of the additional services is $455,229. The total assessment would then be $3,065,892. Assessments will be based upon the Basic Assessment Unit (AU), which is defined to be one single family residence. Vacant lots will be assessed for half that amount, and commercial property will be assessed based upon the use and/or size of the parcel. Provisions for a Rebate Program have been made in the Resolution of intention to low and middle income persons or families having an annual income of less than $12,000 for a single person and $15,000 for two or more people in one household. Those who qualify may apply once a year , in May. The estimated annual assessment for the 1990/91 fiscal year is $48.00 per AU. The Resolution of Intention limits any annual increases in the total assessment to Consumer Price index. The Resolution of Intention also makes provisions for an annual review, by the Mayor and Common Council, to determine that the "Net Proceeds" are being spent on police services, and if not, then to terminate the district. The district will be in effect for a period of five years, unless extended by the mayor and Common Council. The Resolution of Intention set Wednesday, June 27, 1990, 7:00 p.m. at Sturges Auditorium, as the date, time and place of the public hearing. On June 8, 1990, all property owners having property within the City of San Bernardino, were given notice by mail, of the public hearing, and the resolution was published in the Sun. It is recommended that the protests, if any, be overruled, the hearing be closed, and find and determine that the public convenience and necessity require the proposed Assessment District . 75.0264 b- fHo . RESOLUTION OF TIlE CITY OF SAN BERNARDINO FINDING AND DETERMINING TIIAT TIlE PUBLIC CONVENIENCE AND NECESSITY REQUIRE CITY WIDE STREET LIGHTING AND STREET SWEEPING SERVICES AND CREATING AN ASSESSMENT DISTRICT TO COVER TIlE COSTS OF SAID SERVICES KNOWN AS ASSESSMENT DISTRICT NO. 994, ORDERING TIlE WORK AND TIIAT TIlE SPECIAL ASSESSMENT, INVESTIGATION AND LIMITATION ACT OF 1931 SHALL NOT APPLY. WHEREAS, the Mayor and Common Counc il of the City of San Bernardino have preliminarily found that the public interest, convenience, and necessity require City-wide street lighting and street sweeping services, as more fully hereinafter described, and the appurtenances and appurtenant work and incidental costs and expenses connection therewith, that the project is feasible, and that the in lands to be assessed will be able to carry the burden of the proposed assessments to pay the costs and expenses thereof; and WHEREAS, the Mayor and Common Council of the City of San Bernardino have, on the 4th day of June, 1990, passed and adopted Resolution No. 90-207 entitled: " "RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY DETERMINING TIIAT TIlE PUBLIC CONVENIENCE AND NECESSITY REQUIRE TIlE FORMATION OF A STREET LIGHTING AND STREET SWEEPING ASSESSMENT DISTRICT; DECLARING ITS INTENTION TO PROCEED TO ORDER WORK WITHIN TIlE DISTRICT, TO BE KNOWN AS ASSESSMENT DISTRICT NO. 994 AND SETTING AND DIRECTING PUBLICATION OF NOTICE OF A TIME AND DATE OF A PUBLIC HEARING.", 21 which said resolution duly and legally was published and notice has 22 23 been given in the manner required by Chapter 12.90 of the San Bernardino Municipal Code; and written objections and protests to the formation 24 of the proposed district, the work to be done or the extent of the 25 26 27 28 district to be assessed were heard and considered. SECTION 3. The work is proposed to be carried out by City forces. If it is determined that the needs require an outside contract, then the City Clerk hereby is directed to post a Notice for five days on or near the door of the Council Chambers of the City Hall inviting sealed proposals or bids when necessary, for doing the work ordered and referring to the specifications on file and to publish a Notice Inviting such proposals for at least two days in the San Bernardino Sun, a newspaper published and circulated in said City. SECTION 4.
