DescriPtion) Finance: Council Notes: s .CITY OF SAN BERNC;RDINO - REQUEST ~R COUNCIL ACTION STAFF REPORT An infrastructure fee was adopted to finance the construction of the balance of public improvements in the Verdemont Area. Public improvements included paving, curbs and gutters, sidewalks, street lighting, roadway excavation, minor storm drains, sewers and water mains. The fee was set at $7,375.00, in order to raise sufficient funds (from the estimated 3,100 units that will be developed) to finance the cost for these improvements. Water mains were included in the list of improvements, in order to avoid cutting the pavement. The cost for installing water mains was $1,307 per unit. Four of the property owners have requested that a Mello- Roos Community Facilities Services District be established to finance their infrastructure fees. During discussion on formation of this district, the owners asked what portion of the normal fees for acquiring water service would be covered by the $7,375.00 fee. A meeting was held with representatives of the Water Department to determine the proper response to this question. The Water Department has a variety of fees, such as main exten- sion charges, transmission line extension charges, acquisition charges, meter fees, etc. A master plan for water facilities is being prepared. After discussing these items in great detail, it was concluded that the amount of water service costs could not be determined with a reasonable degree of confidence at this time. Therefore, it was decided that the $1,307 for water service should be deleted from the fee. Deletion of the water service cost will reduce the infrastructure fee from $7,375.00 to $6,068.00. This deletion will not have any effect upon the amount of funds available for other infrastructure items. We will make every attempt to have the water lines installed before pavement is placed. We recommend that the fee be reduced by the $1,307 for water system improvements. URGENCY CLAUSE: The election for the Community Facilities District will be held on 6-20-90. It is imperative that the fee be reduced prior to that date, in order to provide necessary assurance to the property owners and avoid their protesting the district. 6-06-90 75-0264 o ~. .c...... 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO REVISING SECTION 1 OF RESOLUTION 90-2 RELATING TO THE AMOUNT OF AN INFRASTRUCTURE 3 FEE TO BE LEVIED FOR RIGHT-OF-WAY IMPROVEMENTS AND PUBLIC IMPROVEMENTS. 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 WHEREAS, the City of San Bernardino, California (the "City") has on January 3, 1990, previously adopted an Urgency (MC-695) Ordinance which established and authorized the levy of an infrastructure fee (the "Infrastructure Fee") for the purposes of funding the costs of certain Right-of-Way Improvements and Public Improvements, all as more fully described in the January Urgency Ordinance; and WHEREAS, in connection with its adoption of the January Urgency Ordinance, the City on January 3, 1990, also adopted a Resolution (Resolution 90-2) setting the amount of the Infra- structure fee; and WHEREAS, the City deems it necessary to adopt this Resolution in order to provide for a revision to the amount of the Infrastructure Fee set in the January Resolution which revision is attributable to the exclusion within the definition of Right-of-Way Improvements as defined in the ordinance, of all water system improvements contemplated in the Engineer's Report. The Infrastructure Fee 4 as established pursuant to the Urgency Ordinance and set by 5 Resolution No. 90-2 is hereby revised to be the amount of 6 $6,068.00 per Equivalent Dwelling Unit as said term is defined in 7 the Ordinance. Said Infrastructure Fee shall be subject to 8 further increase pursuant to the terms of any subsequent 9 resolutions to be adopted by the Mayor and Common Council as may 10 be deemed necessary in the best interests of the City.
