DescriPtion) Signals - 9th Street, "H" to (U~ J:). . ---- Sierra Way Finance: Council Notes: /.J 'CiT~ OF SAN BER""-DINO - REQUEST ~R COUNCIL ACTION STAFF REPORT The Federal Highway Administration uses a program supplement to obligate Federal-Aid funds. Program Supplement No. 60 will serve to obligate $409,400 in Federal-Aid Urban Funds to finance 100% of the construction and construction engineering costs for modifying the traffic signals on "E" Street, from 6th Street to 9th Street, and 9th Street, from "H" Street to Sierra Way. An amount of $19,200 will be obligated by Program Supplement No. 61 for 100% of the preliminary engineering cost. We recommend that these program supplements be approved. URGENCY CLAUSE In order for this project to be funded from the 1989/90 State Budget, these program supplements must be fully executed before the end of this fiscal year. Ii Ii BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE I CITY OF SAN BERNARDINO AS FOLLOWS: I I 3 4 5 6 7 SECTION ONE: The Mayor of the City of San Bernardino 8 is hereby authorized to execute, in behalf of said City, 9 Program Supplements No. 60 and 61 of Local Agency Federal-Aid 10 Safety Improvement Projects, between said City and the State of California, acting by and through its Department of Trans- 11 ]2 portation, a copy of which is attached hereto marked Exhibit 13 "A" and incorporated herein by reference as fully as though set ]4 forth at length herein. ]5 SECTION TWO: The agreement shall not take effect until ]6 fully signed and executed by all parties. This Program supplement is adopted in accordance with Paragraph 2 of Article II of the aforementioned Master Agreement under authority of Resolution No. , approved by the Local Agency on (See copy attached). The Local Agency further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply. with the covenants or remarks setforth on the following pages. The Local Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the contract. 1. 3. The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2)/Detail Estimate, or its modification (PR-2A) or the FNM-76, and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of Local Streets and Roads. 4. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the 'Nondiscrimination Assurances' contained in the aforementioned Master Agreement for Federal-Aid Program. 5. Whenever the local agency uses Federal or State Funds to pay a consultant on a cost plus basis, the local agency is required to submit a post audit report covering the allowability of cost payments for each individual consultant or sub-contractor incur- ring over $25,000 on the project. The audit report must state the applicable cost principles utilized by the auditor in determining allowable costs as referenced in CFR 48, part 31, Contract Cost Principles.
