Program Supplement No. 59 $222,000 in Federal-Aid Urban Funds 100% funded by the Federal funds. will serve to obligate for this project, which is We recommend that authorization be granted for the execution of Program Supplement No. 59. URGENCY CLAUSE: The City has been advised by Caltrans' Local Assistance that failure to execute this program supplement and process it before the close of the fiscal year will result in an anticipated two- month delay in funding. The State is not expected to adopt a budget until well after the close of the fiscal year and, al though it would likely be funded in the next year, approval now will insure funding in the current fiscal year. 6-05-90 c ..., -- 1 RESOLUTION NO. 2 RESOLUTION OF OF SAN BERNARDINO 3 SUPPLEMENT NO. 59 IMPROVEMENT PROJECTS, 4 CALIFORNIA, ACTING TRANSPORTATION. THE MAYOR AND COMMON COUNCIL OF THE CITY AUTHORIZING THE EXECUTION OF PROGRAM OF LOCAL AGENCY FEDERAL-AID SAFETY BETWEEN SAID CITY AND THE STATE OF BY AND THROUGH ITS DEPARTMENT OF 5 6 7 8 is BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: The Mayor of the City of San Bernardino hereby authorized to execute, in behalf of said City, 9 Program Supplements No. 59 of Local Agency Federal-Aid Safety 10 Improvement Projects, between said City and the State of 11 California, acting by and through its Department of Trans- 12 portation, a copy of which is attached hereto marked Exhibit 13 "A" and incorporated herein by reference as fully as though set 14 forth at length herein. 15 SECTION TWO: The agreement shall not take effect until 16 fully signed and executed by all parties. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency and/or the respective agencies as determined by agreement at regular intervals or as required for efficient operation of the completed improvements. 2. The Local Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the contract. 3. The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2)/Oetail Estimate, or its modification (PR-2A) or the FNM-76, and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Oivision of Local Streets and Roads. 4. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the 'Nondiscrimination Assurances' contained in the aforementioned Master Agreement for Federal-Aid Program. 5. Whenever the local agency uses Federal or State Funds to pay a consultant on a cost plus basis, the local agency is required to submit a post audit report covering the allowability of cost payments for each individual consultant or sub-contractor incur- ring over $25,000 on the project. The audit report must state the applicable cost principles utilized by the auditor in determining allowable costs as referenced in CFR 48, part 31, Contract Cost Principles.
