Program Supplement No. 62 will serve to obligate $3,000 in Federal-Aid Urban funds for installation of traffic signals at Del Rosa Drive and 9th Street. We recommend that Program Supplement No. 62 be approved. URGENCY CLAUSE: The City has been advised by Cal trans' Local Assistance Office that Program Supplement No. 62 will need to be approved by the City and returned by 6-22-90, in order for this project to be funded from the current State budget. Failure to execute this program supplement prior to this date will mean that funding will have to be deferred until the new State budget is adopted. 6-11-90 75-0264 . RESOLUTION OF OF SAN BERNARDINO SUPPLEMENT NO. 62 IMPROVEMENT PROJECTS, ,CALIFORNIA, ACTING TRANSPORTATION. THE MAYOR AND COMMON COUNCIL OF THE CITY AUTHORIZING THE EXECUTION OF PROGRAM OF LOCAL AGENCY FEDERAL-AID SAFETY BETWEEN SAID CITY AND THE STATE OF BY AND THROUGH ITS DEPARTMENT OF BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: The Mayor of the City of San Bernardino is hereby authorized to execute, in behalf of said City, Program Supplement No. 62 of Local Agency. Federal-Aid Safety Improvement Projects, between said City and the State of California, acting by and through its Department of Trans- portation, a copy of which is attached hereto marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length herein. SECTION TWO: The agreement shall not take effect until fully signed and executed by all parties. The City shall not be obligated hereunder unless and until the agreement is fully executed and no oral agreement relating thereto shall be implied or authorized. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency and/or the respective agencies as determined by agreement at regular intervals or as required for efficient operation of the completed improvements. 2. The Local Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the contract. 3. The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2)/Detail Estimate, or its modification (PR-2A) or the FNM-76 , and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of Local Streets and Roads. 4. Construction will be programmed as a separate program under Combined Road Plan procedures. 5. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the 'Nondiscrimination Assurances' contained in the aforementioned Master Agreement for Federal-Aid Program. 6. Whenever the local agency uses Federal or State Funds to pay a consultant on a cost plus basis, the local agency is required to submit a post audit report covering the allowability of cost payments for each individual consultant or sub-contractor incur- ring over $25,000 on the project. The audit report must state the applicable cost principles utilized by the auditor in determining allowable costs as referenced in CFR 48, part 31, Contract Cost Principles.
