REOUEST To adopt 15.20.050, certificate days. an ordinance which amends Municipal Code, Section to require landscaping prior to issuance of a of occupancy for buildings vacant more than 180 BACKGROUND At the request of the Mayor and City Administrator, an ordinance was developed to require landscaping prior to issuance of a certificate of occupancy for buildings vacant more than 180 days. If the landscaping that is required by Code results in less parking than otherwise is required, the Planning Director may waive up to a 10 percent deviation. CALIFORNIA ENVIRONMENTAL OUALITY ACT At its regularly scheduled meeting of May 3, 1990, the Environmental Review Committee proposed and recommended a Negative Declaration for the ordinance amendment. The proposed Negative .Declaration was advertised and available for public review from May 10, 1990, through May 30, 1990. No comments were received from the public during this period. RECOMMENDATION That the ordinance amending section 15.20.050, to require landscaping prior to issuance of a certificate of occupancy for buildings vacant more than 180 days; and, that the Nega- tive Declaration be adopted. ".\ o :) .....,.; ORDINANCE NO. ORDINANCE OF THE CITY OF SECTION 15.20.050 TO REQUIRE ISSUANCE OF A CERTIFICATE OF VACANT MORE THAN 180 DAYS. SAN BERNARDINO AMENDING LANDSCAPING PRIOR TO OCCUPANCY FOR BUILDINGS THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. section 15.20.050 of the San Bernardino Municipal Code is amended as follows: "15.20.050 Application Process. A. The owner shall file a written application accompanied by a payment of a fee with the Planning and Building Services Director prior to use or occupancy of the premises or thirty (30) days prior to expiration of an existing certificate of occupancy or temporary certificate of occupancy. The Planning and Building Services Director, upon request of the owner, shall cause an inspection to be made of the premises within ten (10) working days for compliance with City codes. If the premises are in compliance with said codes, the Planning and Building Services Director shall issue a certificate of occupancy. B. When an inspection discloses that the premises are not in compliance with the codes, the Planning and Building Services Director shall give written notice of each deficiency No certificate of to the owner. occupancy shall be issued to the owner until all deficiencies are corrected. When property is vacant for more than 180 4 days, the owner shall landscape the property, in 5 accordance with a landscaping plan approved by the Parks 6 and Recreation, Planning and Building Services, and 7 Public Works Departments of the City of San Bernardino, 8 prior to issuance of a certificate of Occupancy for the 9 building. The landscaping may result in up to a 10% 10 reduction of the total required parking spaces than 11 otherwise required by law if the Planning and Building 12 Services Director approves a minor parking exception. 13 D.
