Bids for maintenance of landscaping in Assessment District No.
991 were opened at 2:00 p.m., on Tuesday, 5-1-90.
A total of
$9,745.00.
Estimate of
two bids were received ranging from $5,720.00 to
The low bid of $5,720.00 is 4.7% under the Engineer's
$6,000.00.
Listed below is an estimate of the total cost of providing these
landscape maintenance services, from 7-1-90 to 6-30-91.

The Notice to Proceed will be effective as of

will be provided pursuant to Resolution No. 89-330, adopted on
8-21-89, which orders the maintenance of the landscaping
installed by the Subdivider. Formation of an assessment district
was a condition of the various tracts.
Maintenance

Cost for maintenance of the landscaping in this district will be
upfronted by the City, as set forth in the Resolution of
Intenti on No. 89-253. These costs wi 11 be reimbursed, wi th
interest, through assessments levied on parcels within the
district.
Inspection of the Contractor's work will be provided by the
Department of Parks and Recreation.
We recommend that a contract be awarded for the low bid.

RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MENTONE TURF SUPPLY FOR MAINTENANCE OF LANDSCAPING IN
ASSESSMENT DISTRICT NO. 991.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Mentone Turf Supply is
the lowest responsible

accordance with Plan No. 7782 (1990-91), for the total amount of

$5,720.00, and contract for the Basic Bid and Supplemental Items,

is awarded to said bidder accordingly, but such award shall be

effective only upon the contract being fully executed by the
parties;
all other bids therefore are hereby rejected; .and the
13
Mayor is hereby authorized and directed to execute said contract
14
on behalf of the City; a copy of the contract is attached hereto,
15
16
marked Exhibit "A" and incorporated herein by reference as fully
as though set forth at length.

SECTION 2. This contract and any amendment or modifica-
18
tions thereto shall not take effect or become operative until
19
fully signed and executed by the parties and no party shall be
20

obligated hereunder until the time of such full execution.
No
oral
amendments,
modifications
waivers
are
agreements,
or
intended or authorized and shall not be implied from any act or
course of conduct of any party.

SECTION 3. This resolution is rescinded if the parties

to the contract fail to execute it within sixty (60) days of the

passage of this resolution.
