STAFF REPORT
Bi ds for maintenance of 1 and scapi ng in Assessment Di stri ct No.
959 were opened at 2:00 p.m. on Tuesday, 5-1-90.
A total of 4 bids were received, ranging from $12,705.00 to
$22,145.00. The low bid of $12,705.00 is 33.1% under the
Engineer's Estimate of $19,000.00.

Funding of the costs incurred for maintenance of this landscaping
will be provided pursuant to Resolution No. 84-448, adopted on
I1-B-84, which orders the maintenance of the landscaping
installed by the Subdivider. Formation of an assessment district
for mai ntenance of 1 andscapi ng was a condi ti on of approval for
the Shandin Hills Development. This district was established on
11-8-84 over all tracts within this development, and will be
implemented as the areas are developed.
Costs for mai ntenance of thi s 1 and scapi ng wi 11 be upfronted by
the City, as set forth in the Resolution of Intention (84-335).
These costs will be reimbursed through assessments levied on all
parcels within the zone of benefit.
Inspection of the Contractor's work will be provided by the
Department of Parks, Recreation and Community Services.
We recommend that a contract be awarded to the low bidder.

RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MENTONE TURF SUPPLY FOR MAINTENANCE OF LANDSCAPING
IN PORTIONS OF KENDALL DRIVE, SHANDIN HILLS CIRCLE, AND SHANDIN
HILLS DRIVE, IN ASSESSMENT DISTRICT NO. 959.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
Mentone Turf Supply is the lowest
7 responsible bidder for Landscaping in portions of Kendall Drive,
8 Shandin Hills Circle, and Shandin Hills Drive, in Assessment
9 District No. 959, in accordance with Plan No. 6363-B (1990-91),
10 for the total amount of $12,705.00, and a contract for the Basic
11 Bid and Supplemental Items, is awarded to said bidder

accordingly, but such award shall be effective only upon the
contract being fully executed by the parties; all other bids
therefore are hereby rejected; and the Mayor is hereby
authori zed and di rected to execute said contract on behalf of
the City; a copy of the contract is attached hereto, marked
Exhibit "A" and incorporated herein by reference as fully as
though set forth at length.
SECTION 2.
Thi s contract and any amendment or
modifications thereto shall not take effect or become operative
until fully signed and executed by the parties and no party
22 shall be obligated hereunder until the time of such full
23 exec uti on.
No oral agreements, amendments, modifications or
24 waivers are intended or authorized and shall not be implied from

any act or course of conduct of any party.
