06-06-88 -- Resolution No. 88-176 adopted awarding a contract to
Cherokee Landscape Services for the low bid price of
$41,623.00.
01-03-89 -- Change Order No. One approved to authorize an
increase in the contract price of $5,945.
06-19-89 -- Change Order No. Two approved to authorize an
extension of one year, adjust the contract prices,
for an increase in the contract price to $62,353.

STAFF REPORT
Bids for this project were opened at 2:00 p.m. on
Tuesday, 5-01-90.
A total of 5 bids were received, ranging from $89,811.22
to $138,159.34. The low bid price of $89,811.22 is 5.4% under
the Engineer's Estimate of $95,400.00.
Listed below is an estimate of the total cost for pro-
viding these landscaping maintenance services, from 7-01-90 to
6-30-91.

The Notice to Proceed will be effective on 7-1-90. The
contract will be in effect until 6-30-91, subject to two one-
year extensions by mutual consent.
Funding for the costs incurred on this project will be
provided pursuant to Resolution No. 81-482, adopted on October
5, 1981, and Resolution No. 81-235 adopted on 6-15-81, which
orders the installation and maintenance of the landscaping. The
landscaping was installed under previous contracts. Costs for
maintenance will be pre-funded by the City, as set forth in the
Resolution of Intention (No. 81-36), and the amount reimbursed
through assessments levied on all parcels wi thin the district
for the following fiscal year.
Inspection of the maintenance effort by the Contractor
will be provided by the Department of Parks, Recreation and
Community Services.
We recommend that a contract be awarded to the low
bidder.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MENTONE TURF SUPPLY FOR MAINTENANCE OF LANDSCAPING IN
3 PORTIONS OF KENDALL DRIVE (STATE ROUTE 206); AND UNIVERSITY
PARKWAY, COLLEGE AVENUE, 48TH STREET, KENDALL DRIVE (STATE ROUTE
4 206), NORTHPARK BOULEVARD AND LITTLE MOUNTAIN DRIVE, ASSESSMENT
DISTRICTS NO. 951 AND 952.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
6 CITY OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. Mentone Turf Supply is the lowest responsible
8 bidder for: Maintenance of landscaping in portions of Kendall
9 Drive (State Route 206), Assessment District No. 951, in
10 accordance with Plan No. 6192-A (1990-91), and in portions of
11 University Parkway, College Avenue, 48th Street, Kendall Drive
12 (State Route 206), Northpark Boulevard and Little Mountain Drive,
13 Assessment District No. 952, in accordance with Plan No. 6056-A
14 (1990-91), for the total amount of $89,811.22, a contract for
15 Schedules No. I and II is awarded to said bidder accordingly, but
16 such award shall be effective only upon the contract being fully
17 executed by the parties; all other bids therefore are hereby
18 rejected; and the, Mayor is hereby authorized and directed to
19 execute said contract on behalf of the City; a copy of the
20 contract is attached hereto, marked Exhibit "A" and incorporated
21 herein by reference as fully as though set forth at length.
22 SECTION 2. This contract and any amendment or modifica-
23 tions thereto shall not take effect or become operative until
24 fully signed and executed by the parties and no party shall be
25 obligated hereunder until the time of such full execution. No
26 oral agreements, amendments, modifications or wai vers are
27 intended or authorized and shall not be implied from any act or
28 course of conduct of any party.
