Synopsis of Previous Council action:
12/16/69 ___ Authorization to proceed was given, and Plan No. 7964 was approved.
03/19/90 ___ Negative Declaration was adopted and a finding of consistency with
the General Plan was made.
05/07/90 Resolution of Intention No. 90-163 was adopted, which sets a
public hearing date of 06/04/90 for the proposed vacation of
a portion of Jefferson Avenue between Pepper Avenue and Eucalyptus
Avenue.
Recommended motion:
1. That the hearing be closed and the Findings of Fact as set forth in the Staff
Report from Roger G. Hardgrave, Director of Public Works/City Engineer as to
why a portion of Jefferson Avenue between Pepper Avenue and Eucalyptus
Avenue, is no longer necessary for street purposes, be adopted.
2. Adopt Resolution.

STAFF REPORT
staff received a request from Rialto Unified School District to vacate a portion of
, Jefferson Avenue between Pepper Avenue and Eucalyptus Avenue. The School District
~has plans to build on the surrounding property and would like to eliminate the short
. section of Jefferson Avenue which bisects the property. ."
Authorization was given on 12/18/89, to proceed with the proposed vacation and Plan
No. 7984 was approved.
Utility companies and City departments were notified of the proposed vacation on
01/12/90, with a reply due by 02/16/90. No negative comments were received.
On 03/19/90, a Negative Declaration was adopted for the proposed vacation, and a
finding of consistency with the General Plan was made. .
On 05/07/90, Resolution of Intention No. 90-163 was adopted, with no easements being
requested. That resolution sets a public hearing date of 06/04/90. On 05/16/90, the
Resolution of Intention was published in a local newspaper, Notices were posted in the
area proposed for vacation, and all property owners adjacent to the proposed vacation
were notified of said hearing.
There appears to be no further necessity for a portion of Jefferson Avenue between
Pepper Avenue and Eucalyptus Avenue, either for present or future street purposes.
Staff recommends the vacation on the basis of the following Findings of Fact:
1. The above portion of the street has been determined by the Department of Public
Works to be of no further necessity to the general public:
a) Negative Declaration was adopted, and a finding of consistency with the
General Plan was made.
b) Traffic flow does not warrant a street in this area.
2. The other adjoining property owner (West San Bernardino County Water District) is
in agreement with the proposed vacation and the required $750.00 fee has been paid.

SECTION 1 :
The Mayor and Co_on Council of the City of San

having heard the evidence offered in relation to the proposed
8 vacation of a portion of Jefferson Avenue between Pepper Avenue and
Eucalyptus
particularly described in City Resolution of

hereby find from all of the evidence submitted

SECTION 2.
The Mayor and Co_on Council of said City do hereby
vacate a portion of Jefferson Avenue between Pepper Avenue and Eucalyptus
Avenue in San Bernardino, California, more particularly described as
follows:
That portion of Jefferson Street as conveyed to the City
of San Bernardino by document recorded August 21, 1963 in
Book 5973, Page 898, Official Records, described as
follows:
That portion of the West one-half of Lot 133, in the Town
of Rialto and adjoining Subdivisions, as per plat thereof
recorded in Book 4 of Maps, Page 11, Records of the
County Recorder of San Bernardino County, State of
California, described as follows:
Beginning at the intersection of the South line of said
Lot 133 with the East line of the West 32.00 feet of said
Lot, said East line being also the East line of
Eucalyptus Avenue (62.00 feet wide); thence South 890 55'
55" East along the South line of said Lot 133, a distance
of 458.00 feet; thence North and parallel with the East
line ot said Lot 133, to the intersection with a line
that is parallel with and 40.00 feet North of, and
measured at right angles to said South line of said Lot
133; thence West and parallel with said South line, a
distance of 438 feet to the beginning of a tangent curve
concave Northeasterly and having a radius of 20.00 feet;
