Backl!round: On November 7,1990, the Planning Commission approved the Tentative Tract No. 14112, a 55- lot, single family, residential subdivision. On May 18, 1994, the Planning Commission authorized an extension of the time limit for approval of the tentative tract map. An automatic two-year extension was granted according to the provisions of Section 66452.11 of the Subdivision Map Act, which extended the approval date to May 18, 1996. An additional extension was granted according to the provisions of Section 66452.13 of the Subdivision Map Act, extending the approval date to May 18, 1998. The Planning Commission approved the final extension, extending the tentative map to May 18, 1999. The Developer/owner requested that staff schedule Tentative Tract 14112 for final map approval by the Mayor and Common Council for the meeting of May 17. 1999. Because the final map and subdivision securities had not been submitted as of the date of the meeting, the Mayor and Common Council approved a motion to continue the Resolution approving the final map to August 16, 1999. The following documents are required for approval of the final map: 1. Bonds - Faithful Performance Bond - $2,293,000.00, Labor Material - $1,146,500.00, Guarantee and Warranty Bond - $573,250.00, Monumentation Bond - $17,000.00, Grading Bond - $1,073,500.00; 2 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT - continued 2. Fees - Street Light Electrical Energy Fee - $[4,656.80, Street Improvement Plan Checking Fee - $61,152.00, Final Map - $2,650.00, Grading Plan Checking Fee - $1,295.50, Traffic Signal Modification Fee - $20,000; 3. Three executed originals of the Subdivision Agreement; 4. Three mylar originals of the Final Map executed by the subdivider/owner and other required signatories, the Engineer, and the County, together with the final Subdivision Guarantee; 5. Off-site improvement plans, including landscape and irrigation plans for the landscape maintenance district all approved by the City Engineer. The original bond amounts and fees were estimated in 1999 without benefit of approved infrastructure improvement plans. The bonding and fee amounts have been increased by 26% from the amounts calculated in 1999 based on the increase in the Engineering News Record cost of construction index. Subsequent to the approval of the infrastructure improvement plans, a new "Recording Requirements" letter will be sent to Sterling Heights, LLC indicating the actual bonding and fee amounts. These actual amounts may vary significantly from the amounts estimated above. This map has been before the Council for the last six and a half years and the previous developer/owner made no attempt to provide anv of the items required for Council approval and recordation of the map. To date, none of the items required for recordation have been submitted to the City for review. If this request for continuance is not approved, Tentative Tract No. 14112 will expire and a new tentative tract map application will be required. Financial Impact: The $75.00 continuance fee has been paid. Recommendation: That the Mayor and Common Council deny the request for continuance of the Final Map for Tentative Tract No. 14112. LLC continues to progress on the development of Tentalil/E! Tract 14112 and is moiling forward with the development of this site into an upscale-gated community on half-acre lots in accordance with the appro\led Tentative Map No. 14112. In an effort to comply with the Conditions of Approval for the approved map. Sterling Heights, LLC has retained the serl/ices of Gary Rasmussen as our Geotechnical Consultant, Tom Dodson as our Environmental Consultant, and Associated Engineers as our Civil Engineer. The actions that we have taken so far include: 1. Gary Rasmussen has completed an updated geotechnical investigation 10 validate the fault zones shown on the approved map. 2. Tom Dodson and Associates has performed habitat surveys, determined preliminary Jurisdictional Delineation of the drainage area on site, and is preparing to submit to the appropriate oversight agencies, as required by the Conditions of Approval. 3. Associated Engineers has performed the following design services: . Performed Field Design Serl/ices . Performed Preliminary Hydrology Services . Met with City staff and County staff on flood control issues. . ~veloped ROug~ ~rading Plans that are currently at the 80% stage. . Hired a Fire SpeClallsl to produce a Fire Zone Report. . Met with various Public Works, Water, and Fire Departments on Preliminary Design Issues. .
