Recommended Motion: I. Authorize the Director of Finance to amend the FY 05/06 budget to reduce the funding allocation of Community Development Block Grant funding for project SS04-36 E Street Bus Stop Relocation to Court Street from $100,000 to $50,000 in Acct. No. 126-000-4670, and 2. Authorize the Director of Finance to amend the FY 05/06 budget by transferring $35,000 from Account No. 126-369-5504-7581 "SS06-01 4th Street cul-de-sac at Mt. Vernon Avenue" to Account No. 126-369-5504- 7322 "SS04-36 "E" Street Bus Stop Relocation to Court Street", and 3. Description: CDBG and Gas Tax Fund Finance: Council Notes: Agenda Item No. CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION Staff Report Subject: Resolution awarding a contract to FS Construction for Beautification Enhancement for Bus Stop on the West Side of "E" Street Adjacent to the Parking Structure Between Court Street and 4th Street (SS04-36) - Project Plan No. 11579 and authorization for the Director of Finance to amend the FY 05/06 Budget. Background: On August 15. 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06 Capital ;~lprovement Program (CIP), for "E" Street Bus Stop Relocation to Court Street. The project consists ofremoval of existing shrubs, planter box, irrigation and uneven sidewalk, construction of new concrete sidewalk. installation of flagstone pavers, seating benches, decorative rocks and river rock. This will create a large flowing decorative area used for a major arterial bus stop and beautification to a downtown hub used by pedestrians going to and from work in the surrounding offices. The plans and specifications for this project have been completed and the project was opened to public bidding on March 7, 2006. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge, High Desert Plan Room, Construction Bid Board, Reed Construction Data, Bid America, Construction Bid Source, Bid Ocean and the City's web sites, and with the San Bernardino Area Chamber of Commerce. Bids have been received and are listed below: Name of Bidder City Amount of Bid Alternate "B" F S CONSTRUCTION SYLMAR $ 62,400.00 Hillcrest Contracting Corona $ 147,230.00 EDl:dneer's Estimate $ 75,000.00 Based on review of the sealed competitive bids received, staff has determined that F S Construction of Sylmar, C A, the apparent low bidder, has met the minimum requirements of the specifications and bid guidelines: and, therefore, recommends that the Mayor and Common Council award the referenced contract to F S Construction. The estimated project costs are as follows: TOTAL $ 62,400.00 S 11.300.00 5 11,300.00 $ 85,000.00 If approv'ed. this project is expected to begin construction in June of 2006 and be completed by July of 2006. Financial Impact: Only S50.000 of the SIOO,OOO of Community Development Block Grant (CDBG) funding as proposed in the FY 05,06 Capital Improvement Program was approved by the Community Development Commission for this proJect. Therefore. the revenue budget for this project needs to be reduced by S50,000. In addition, based on a tlltal project cost of 585,000, a supplemental allocation in the amount of $35,000 from gas tax is needed to fully fund this project. 2 05103/20069:28 AM CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION Staff Report (Continued) Staff recommends that $35,000 in gas tax funds be transferred from Account No. 126-369-5504-7581 "SS06-0 I 4'" Street cul-de-sac at Mt. Vernon Avenue" to Account No. 126-369-5504-7322 "SS04.36 E Street Bus Stop Relocation to Court Street". The construction of a cul-de-sac on 4,h Street at Mt. Vernon A venue will occur concurrently with the Mt. Vernon Bridge replacement. Since the construction will not occur this fiscal year, S35,000 can be transferred to SS04-36 "E" Street Bus Stop Relocation to Court Street, and the funding restored to the 4,h Street cul-de-sac project as part of the FY 06/07 budget. Recommendation: I. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO F S CONSTRUCTION FOR BEAUTIFICATION ENHANCEMENT FOR BUS STOP ON THE WEST SIDE OF "E" STREET ADJACENT TO THE PARKING STRUCTURE BETWEEN COURT STREET AND 4TH STREET (SS 04-36) PER PROJECT PLAN NO. 11579. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. F S Construction, 13368 Aldergrove Street, Sylmar, CA 91342, is the lowest responsible bidder for Beautification Enhancement for Bus Stop on the West Side of"E" Street Adjacent to the Parking Structure Between Court Street and 4th Street (5504-36) per Project Plan No. 11579 A contract is awarded accordingly to said bidder in a total amount of $ 62,400.00, with a contingency amount of $11,300.00, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3.
