Description: Yz-Cent Sales Tax Finance: Council Notes: l2e-so. 200(p -/3/ 5/J~/D(, Agenda Item No. J.3 CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION Staff Report Subject: Resolution awarding a contract to J.D.C., Inc. for the Construction of Sidewalk at Medical Center Drive from 19th Street to Highland Avenue, Phase Vlli- 2005/06 (55-B) per Plan No. 11684. Background: On August 15, 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06 Capital Improvement Program (CIP), for the Construction of Sidewalk at Medical Center Drive from 19th Street to HIghland Avenue, Phase VIII - 2005/06, (55-B). This project was requested at a meeting between city officials and a parents group at Ingram Elementary School. Among other issues, the parents noted a problem with lack of accessible pedestrian facilities along Medical Center Drive and requested a sidewalk be installed along the west side of the street. This project will improve the safety and accessibility for children on their way to school and provide a safe, accessible path for pedestrians walking to Community Hospital and other nearby destinations. ThIS project consists of construction of new ADA accessible sidewalk, construction of ADA bypasses at obstacles such as power poles, street lights, fire hydrants, etc., grading and adjustment of utilities, replacement of stripmg and roadway improvements damaged or temporarily removed by the contractor during construction. This contract is a part of our annual project to eliminate barriers within the public right-of-way throughout the City. The locations to receive improvements were based, in part, on a survey of intersections conducted in May 2000. Critena for establishing a priority list of locations to receive ADA improvements were developed based on the proximity of government building, schools, hospitals, retail, entertainment and recreation sites (city parks etc.). Staff also maintains a list of locations needing improvements identified by the Mayor, City Council, and by the public. Areas of the City to receive improvements are rotated each year so that all parts of the City will eventually receive improvements. The overall goal is to eliminate all barriers throughout the City. The plans and specifications for this project have been completed and the project was opened to public bidding on April 4, 2006. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge. High Desert Plan Room, Construction Bid Board, Reed Construction Data, Bid America, Construction Bid Source, Bid Ocean and the City's web sites, and with the San Bernardino Area Chamber of Commerce. Engineer's Estimate $ 31,446,00 2 04/20/2006 3:U4 PM CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION Staff Report (Continued) Based on review of the sealed competitive bids received, staff has determined that J.D.C., Inc. of Rancho Cucamonga, CA, the apparent low bidder, has met the minimum requirements of the specifications and bid guidelines; and, therefore, recommends that the Mayor and Common Council award the referenced contract to J.D.C., Inc. The estimated project costs are as follows: TOTAL Construction Bid $ 25,978.20 Contract ManaQement and Insoection (Approx. 15%) $ 3,760.90 Contingencies (Aoorox. 15%) $ 3,760.90 Estimated Total Proiect Cost $ 33,500.00 If approved, this project is expected to begin construction in June of 2006 and be completed by July of 2006. Financial Impact: Accessibility improvements citywide are normally funded from Account No. 129-367-5504-7202 "SS-B Construct Accessibility Improvements at Various Locations (Annual)". Due to substantially increases in bid pnces within the last year, the account balance has been expended on other accessibility projects. Staff has identified Project SS04-48 "Rancho Avenue Median Construction" as a potential source of funds for this proJect. SS04-48 consists of construction of a median island in Rancho Avenue on the north and south sides of the BNSF railroad tracks south of Foothill Boulevard to enable installation of crossing gates. SS04-48 is under design, however, coordination requirements with BNSF have delayed the project such that it cannot be bid thIS fiscal year. Therefore. staff is recommending that funding in the amount of $33,500 be transferred from Account No. 129- 367-5504-7381 "SS04-48 Rancho Avenue Median Construction" to Account No. 129-367-5504-7202 "SS-B Accessibility Improvements at Various Locations (Annual)" for Construction of Sidewalk at Medical Center Dnve from 19'" Street to Highland Avenue, Phase VIIT, per plan No. 11684. Approximately S36,400.00 will remain in the account for SS04-48, which will be adequate to complete the design. Construction funding will be restored to the project in the coming fiscal year. Recommendation: I. Authorize the Director of Finance to amend the FY 05/06 Budget by transferring S33,500 from Account No. 129-367-5504-7381 "SS04-48 Rancho Avenue Median Construction" to Account No. 129-367-5504-7202 "SS-B Accessibility Improvements at Various Locations (Annual)". 2. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO J.D.C., INC. FOR CONSTRUCTION OF SIDEWALK AT MEDICAL CENTER DRIVE FROM 19TH STREET TO HIGHLAND AVENUE, PHASE VIII - 2005/06 (SS-B), PER PLAN NO. 11684. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION I. J.D.C., Inc. 13061 Shasta Court, Rancho Cucamonga, CA 91739 is the lowest responsible bidder for Construction of Sidewalk at Medical Center Drive from 19th Street to Highland Avenue, Phase VIII- 2005/06 (SS-B), per Plan No. 11684. A contract is awarded accordingly to said bidder in a total amount of $25,978.20, with a contingency amount of $3,760.90, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of passage of the resolution.
