HARDGRAVE Subject: 10:00 a.m. Protest Hearing -- Proposed Community Facilities District No. 995 -- Verdemont Area Dept: Public Works/Engineering Date: 5-16-90 Synopsis of Previous Council action: 12-04-89 Urgency Ordinance No. MC-670 adopted levying an Infrastructure Fee. 02-19-90 Urgency Ordinance No. MC-707 adopted requiring the levy of the Verdemont Infrastructure Fee. 03-19-90 Resolution No. 90-103 adopted authorizing City Engineer to proceed. 03-19-90 Resolution No. 90-103 adopted accepting petition and designating Bond Counsel, Underwriter and Special Tax Consultant. 04-16-90 -- Resolution No. 90-136 and 90-140 adopted declaring City's intent to issue bonds and intent to establish district. Recommended motion: 1. That proposed Community Facilities District No. 995 be reduced in size by the deletion of Tract No. 13603. 2. However, one of the parcels is being subdivided by Monnig Development, Inc. Since most of the homes in this tract have been sold, this property will necessarily be deleted from the proposed district. The description of the improvements to be constructed was inadvertently omitted from the legal advertising. There- fore, it will be necessary for the Public Hearing to be con- tinued until the Council meeting of 6-4-90, in order to allow sufficient time for the description of the improvements (Exhibit "B" to the Resolution of Intention) to be published in The Sun. An opportunity for public testimony should be afforded before the hearing is continued. We recommend that Tract No. 13603 be deleted, and the public hearing continued to 6-4-90. 5-16-90 75-0264 ,....
