The condition of this street vacation be removed in writing from our Review of Plans 89-1. 2. Reserve the right to apply for this vacation of Caroline Street at a later date with the understanding that the proceedings would have to begin from the beginning again. I own the property located at 2225 Club Way. This property is currently at the Southeast corner of the in- tersection of Club Way and Caroline St. The building is leased to Econo- lube "N" Tune. It Is my opinion that the proposed vacation would seriously detract from the value of my property for the following reasons: * The building faces North to~ard Caroline Street and would no longer be orientated toward the right direction for traffic flow. * My lot would not be a corner lot. * The vacation would seriously impact my tenant's business. The purpose of this letter is to tell the City that Econo Lube N' Tune, Inc. strongly discourages the vacation of Caroline Street for the following reasons: The primary access to the entrance and staging area of this business is from the driveway located on Caroline Street. A good portion of the customers that use Econo Lube N' Tune come from Waterman Avenue via Caroline Street. The vacation of this street would literally deny access and cause severe hardship to an established business. Please be advised that we will attend the hearing on May 7, 1990 to protest this action. Sunset Group was to vacate a portion of Caroline street lying between Club Way and Sunset Drive. Sunset Group owns most the land in the immediate area and plans to extend the North/South leg of Caroline Street (that portion will be re-named Sunset Drive) to Redlands Boulevard. Authorization was given on 11/06/89. to proceed with the proposed vacation and Plan No. 7944 was approved. Utility companies and City departments were notified of the proposed vacation on 01/12/90. with a reply due by 02/16/90. No negative comments were received. On 02/05/90. a Negative Declaration was adopted for the proposed vacation, and a finding of consistency with the General Plan was made. On 04/02/90. Resolution of Intention No. 90-114 was adopted. reserving an easement for public utilities and a sewer main. over a portion of the area planned for vacation. That resolution sets a public hearing date of 05/07/90. On 04/11/90, the Resolution of Intention was published in a local newspaper. Notices were posted in the area proposed for vacation. and all property owners adjacent to the proposed vacation were notified of said hearing. There appears Club Way and recommends the to be no further necessity for that portion of Caroline Street between Sunset Drive, either for present or future street purposes. Staff vacation on the basis of the following Findings of Fact: 1. The above portion of the street has been determined by the Department of Public Works to be of no further necessity to the general public: a) Negative Declaration was adopted. and a finding of consistency with the General Plan was made. 2. The required $400.00 fee has been paid. 3. All of the concerned City Departments and Utility Companies were notified of the proposal and all have had the opportunity to respond. Reservation of an easement for Public Utilities has been reserved over a portion of the proposed vacation. as were reservations of easements for sanitary sewer and water and appurtenant facilities, and the same have been provided for in the Resolution of Intention. No special requirements have been placed upon the proponents relative to the proceedings which would require an inspection of the area prior to the adoption of the Resolution Ordering Vacation. The Mayor and Common Council of said City do hereby 15 vacate a portion of Caroline Street between Club Way and Sunset Drive in San 16 Bernardino. California, more particularly described as follows: 17 All that portion of Caroline Street lying between the prolongation of the Easterly line of Club Way (Concourse 18 Way), as delineated on Parcel Map 8401, as per map recorded in Book 34 of Parcel Maps, Pages 83 and 84, in 19 the office of the County Recorder of San Bernardino County, and between the Northerly prolongation of the 20 Westerly line of Sunset Drive as delineated on Parcel Map 11148, as per map recorded in Book 114 of Parcel Maps, 21 Pages 2 and 3, records of said County. 22 And is also described in said Resolution of Intention No. 90-114. 23 SECTION 3.
