Council Notes: AQenda Item No. .30 CITY OF SAN BERN....~DINO - REQUEST F,"", COUNCIL ACTION STAFF REPORT Program Supplement No. 56 will serve to obligate $24,782 in Federal-Aid Urban Funds to finance the preliminary engineering costs for rehabilitating the pavement on Baseline Street, from Medical Center Drive to Crestview Avenue. Local funds in the amount of $3,888 will be needed to match the Federal-Aid funds. An amount of $970,600 has been allocated, under Account No. 242-362-57669, to finance the total project costs. At their meeting of 9-21-89, the Environmental Review Committee found that this project was categorically exempt from the provisions of the California Environmental Quality Act. Approval to commence preliminary engineering was granted by letter of 3-13-89, from Caltrans. The plans, specifications and estimate should be ready to be submitted to Caltrans for checking. We recommend that Program Supplement No. 56 be approved. 3-23-90 75-0264 1 2 3 4 5 RESOLUTION NO. RESOLUTION OF OF SAN BERNARDINO SUPPLEMENT NO. 56 IMPROVEMENT PROJECTS, CALIFORNIA, ACTING TRANSPORTATION. THE MAYOR AND COMMON COUNCIL OF THE CITY AUTHORIZING THE EXECUTION OF PROGRAM OF LOCAL AGENCY FEDERAL-AID SAFETY BETWEEN SAID CITY AND THE STATE OF BY AND THROUGH ITS DEPARTMENT OF BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 6 CITY OF SAN BERNARDINO AS FOLLOWS: 7 SECTION ONE: The Mayor of the City of San Bernardino 8 is hereby authorized to execute, in behalf of said City, 9 Program Supplement No. 56 of Local Agency Federal-Aid Safety 10 Improvement Projects, between said City and the State of 11 California, acting by and through its Department of Trans- 12 portation, a copy of which is attached hereto marked Exhibit 13 "A" and incorporated herein by reference as fully as though set 14 forth at length herein. 15 SECTION TWO: The agreement shall not take effect until 16 fully signed and executed by all parties. This Program supplement is hereby incorporated into the Local Agency-state Agreement for Federal Aid which was entered into between the Local Agency and the State on 04/06/78 and is subject to all the terms and conditions thereof. This Program supplement is adopted in accordance with paragraph 2 of Article II of the aforementioned Master Agreement under authority of Resolution No. , approved by the Local Agency on (See copy attached). The Local Agency further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comp~y with the covenants or remarks setforth on ~he following pages. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency and/or the respective agencies as determined by agreement at regular intervals or as required for effic~ent operation of the completed-improvements. 2. The Local Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the contract. 3. The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2l/Detail Estimate, or its modification (PR-2A) or the FNM-76, and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of Local Streets and Roads. 4. Construction will be programmed as a separate program under Combined Road Plan procedures. 5. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the 'Nondiscrimination Assurances' contained in the aforementioned Master Agreement for Federal-Aid Program. 6. Whenever the local agency uses Federal or State Funds to pay a consultant on a cost plus basis, the local agency is required to submit a post audit report covering the allowability of cost payments for each individual consultant or sub-contractor incur- ring .over $25,000 on the project. The audit report must state the applicable cost principles utilized by the auditor in determining allowable costs as referenced in CFR 48, part 31, Contract Cost principles.
