STAFF REPORT
A request was received by this office to vacate this "U" shaped alley, from Doug
Goodman of Goodman & Associates, representing the Housing Authority of the County
of San Bernardino. The Housing Authority would like to eliminate the loitering
and trespassing that tak7'Place in the alley, and they would like to make better
use of the part of the alley that divides their properties.
On 12-04-89, authorization was given to proceed with the proposed vacation, and
Plan No. 7968 was approved.
All of the interested City Departments and utility Companies were notified
of the proposal on 01-12-90, with a reply due by 02-16-90. The responses are
attached for your information. No reservations of easements were requested by any
City Department or any public utility company.
On 03-05-90, a Negative Declaration was adopted and a finding of consistency
with the General Plan was made.
The remaining fee of $200.00 has been paid and it is recommended that favorable
consideration be given to the requested vacation. The' Resolution of Intention,
which sets a protest date of 05-07-90 has been attached hereto for your action
also.
Upon the approval of said Resolution, all adjacent property owners will be
notified by mail of the hearing date.

2 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF A "U" SHAPED ALLEY BETWEEN 10TH STREET AND OLIVE
3 STREET, AND BETWEEN ARROWHEAD AVENUE AND "D" STREET.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:

SECTION 1.
That the Mayor and Common Council of the City of
7 San Bernardino hereby declares its intention to order the vacation of a
8 "U" shaped alley between 10th Street and Olive Street. and between Arrowhead
9 Avenue and "D" Street, described as follows:

That certain 12 foot North/South alley; 15 foot EastjWest
alley; 9 foot North/South alley, as delineated on the map
of Home Builders Monte Vista Tract, as per plat recorded
in Book 18 of Maps, Page 58, in the office of the County
Recorder of San Bernardino County, State of California,
adjoining Lots 3, 4, 5, 6, 9, 10, 11, 12, 13, and 14 of
said Tract; TOGETHER WITH the South 155 feet of Lot 18 of
said Tract, as described in the deed to the City of San
Bernardino by document No. 129, recorded April 2, 1929,
in Book 481, Page 243, Official Records of said County.
SECTION 2.
That the Mayor and Common Council of the City of San
17 Bernardino, in vacating the above described portion of said streets, elects
18 to proceed under and in accordance with the provisions of the "Public
19 Streets, Highways and Services Vacation Law", being Division 9, Part 3, of
20 the Streets and Highways Code of the State of California.

SECTION 3.
That the hour of 10:00 A.M. on the 7th day of May,
in the Council Chamber of the City Hall, San Bernardino, California,
be,
23 and the same hereby is fixed as the time and place when and where all
24 persons interested in or objecting to the proposed vacation may appear
25 before the
said Mayor and Common Council and offer evidence in
26 relation thereto.
For further particulars as to the proposed vacation of
27 the hereinbefore described portion of said streets, reference is made to
28 that map marked "Plan No. 7968 approved December 4, 1989, on file in the

SECTION 4. Nothing in this Resolution shall in any way affect or
disturb any existing easements for public utility purposes belonging
either to the City of San Bernardino or to any public utility.
SECTION 5. That the City Engineer of the City of San Bernardino
hereby is directed to cause Notices of Street Vacation to be posted as
required by the Public Streets, Highways and Services Vacation Law.
SECTION 6. That the City Clerk shall certify to the adoption of
this Resolution of Intention and shall cause the same to be published once a
week for two successive weeks in Tbe Sun, a newspaper published and
circulated in the City of San Bernardino, prior to the date of the above
public hearing.
