RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING A
NINETY (90) DAY EXTENSION TO THE AGREEMENT WITH GERALD M.
NEWCOMBE TO ASSUME RESPONSIBILITY FOR THE OVERALL MANAGEMENT AND
OPERATION OF THE CITY OF SAN BERNARDINO FIRE DEPARTMENT DURING
THE PERIOD OF RECRUITMENT AND SELECTION PROCESS.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor is hereby authorized and directed
to execute on behalf of said city an extension to the Agreement
with Gerald M. Newcombe to assume responsibility for the overall
management and operation of the City of San Bernardino Fire
Department for a period not to exceed ninety (90) days from the
passage of this resolution.
SECTION 2.
The authorization to execute the above
referenced agreement
is rescinded if the
parties to the
agreement fail to execute it within sixty
(60) days of the
passage of this resolution.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a meeting thereof, held on the

AMENDMENT TO AGREEMENT

THIS AMENDMENT TO AGREEMENT is made and entered into this

, 1990, by and between the CITY OF SAN

BERNARDINO, hereinafter called "City," and GERALD M. NEWCOMBE,

hereinafter called "Consultant,"

WITNESSETH:
WHEREAS, the parties entered into that certain Agreement
for Consultant's services dated December 18, 1989, and
WHEREAS, the parties desire now to extend said Agreement
for an additional ninety (90) day period,
NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS:
1. Paragraph 2 of said Agreement is hereby amended to
read as follows:
"2. Term. This Agreement shall commence as of the day and
year first above written and shall remain in full force and

effect for a period of one hundred eighty (180) days from
said date unless sooner terminated as provided herein.
Thereafter, this Agreement may be extended by the City
Administrator for a period not to exceed ninety (90) days."
2. Except as amended herein, the original Agreement shall
remain in full force and effect.
