DescriPtion) Assessment D~NO. 990-- ))~ Hiqhland Avenue and Arden Avenue Finance: Council Notes: 75.0262 Agenda Item No. ~ CITY OF SAN BEIb.ARDINO - REQUEST ...OR COUNCIL ACTION STAFF REPORT Bids for providing security service, wi thin the area bounded by Highland Avenue, Arden Avenue, Guthrie Avenue, and alley south of 20th Street, were opened at 2:00 p.m. on Tuesday, 2-06-90. Only one bid was received, in the amount of $42,224.00 for a one year period. The basic bid of $42,224.00 is l7.3% over the estimate of $36,000, set forth in the Engineer's Re- port for providing security services. The total annual estimate of cost for Assessment District No. 990 contained street sweeping and electrical energy costs for a total of $45,460, which is higher than the bid. A supplemental bid price was also solicited, for pro- viding up to 20 hours of overtime on an as needed basis. Bid specifications were mailed directly to l2 security firms. However, only the firm currently providing these services for the majority property owner submitted a bid. Some of the other firms are no longer in business and some felt the specifications were too restrictive. The contract documents were prepared to allow for two one-year extensions, by mutual agreement of the City and Con- tractor. We plan to review the contract specifications and make revisions as indicated, in order to secure wider participation by prospective bidders. The contract can then be extended, or a new contract awarded as deemed appropriate. Considerable interest has been expressed in this process of providing security service. We feel that requests may be received to expand the district, which could serve to reduce the assessments for parcels within the present boundaries. We feel it would be advisable to award a contract for this bid, to get this program started. ~ The estimated cost of this contract, from 3-05-90 to 6- 30-90 is $l3,572. These funds will be up-fronted by the City as , ftxpenditures are incurred, and will be reimbursed from annual 1/ assessments placed against the properties involved. Interest will also be recovered on the funds advanced. Even though the bid is in excess of the estimated amount in the Engineer's Report, the total cost of the district for the remainder of the 198~/90 fiscal year will be less than the amount estimated, since the street sweeping and lighting programs have not been initiated. Parker Protective Services dba Blanket 7 Security is the lowest responsible bidder for Providing Security 8 Services for Assessment District No. 990 (Highland Avenue and 9 Gu~hrie Street), in accordance with Plan No. 7791, for the Basic 10 Rid in the amoun~ of $l3,572.00, and a contract is awarded to. 11 said bidder accord~ngly, but such award shall be effective only 12 upon the contract being fully executed by the parties; all other 13 bids therefore are hereby rejected; and the Mayor is hereby 14 authorized and directed to execute said contract on behalf of the 15 City; a copy of the contract is attached heret6, marked Exhibit 16 "A" and incorporated herein by reference as fully as though set 17 forth at length. 18 SECTION 2. This contract and any amendment or nodifica- 19 tions thereto shall not take effect or becone operative unt.il 20 fully signed and executed by the parties and no party shall be 21 obligated hereunder until the time of such full execution. Highland Avenue and Arden Avenue DATE: March 15, 1990 FILE NO: 14.40-61; Reading File ------------------------------------------------------------------- This item was continued to 3/19/90, in response to the concern expressed by the Ci ty Attorney rel ati ve to 1 i abi 1 i ty insurance requirements. These concerns stemmed from the possibility of the security guards becoming involved in a shooting incident, since they wi 11 be armed. Section 5-1.01, "LIABILITY INSURANCE", of the Special Provisions requires the Contractor to furnish the City with a policy of liability insurance with a minimum limit of $250,000.00 for each person and $500,000.00 for each occurrence. The City Attorney has indicated that he felt these limits should be $1,000,000.00 and $2,000,000.00 respectively. The Contractor was requested to provide a price quote for providing the increased insurance coverage for the remainder of this fiscal year. A quote of $0.91 per hour has been furnished. This change will increase the contract unit price from $14.50 to $15.41 per hour. For the expected contract period, from 4/2/90 to 6/30/90, this adjustment in the contract unit price will increase the total contract cost by an amount of $655.20, from $10,440.00 to $11,095.20. You indicated a change in the insurance needs for the above-listed bid. The City of San Bernardino now needs liability insur- ance of $1,000,000.00 per person, $2,000,000.00 per incident. A check with our insurance carrier shows the coverage required would increase our costs $2,670.00 per year. The contract calls for 2,920 hours per year. This would give a cost of .91 cents per hour. For the service as previously bid at $14.50 per hour plus the .91 per hour for the amendment, the cost to you would be $15.41 per hour. If you have any questions, please feel free to call. The Supervisor shall have the right to interview any security officer on the project site in order to verify payment of prevailing wage rates. Also, the City retains the right to examine the Contractor' s payro 11 records to determine if wage rates indicated are being paid. 5-1.04 SAFETY REQUIREMENTS -- All work performed under this contract shall be performed in such manner as to provide maximum safety to the public. The Supervisor reserves the right to issue restraint or cease and desist orders to the Contractor when unsafe or harmful acts are observed or reported relative to the performance of the work under this contract. 5-1.05 HAZARDOUS CONDITIONS -- The contractor shall maintain the area free of hazards to persons and/or property resul ting from his/her operations. Any hazardous conditions noted by the Contractor, which is not a result of his/ her operations, shall immediately be reported to the Manager(s). 5-1.06 USE OF FIREARMS -- Security personnel shall bear firearms during patrol of the contract area. The contractor and security personnel shall meet all qualifications and requirements, including certification, testing and permits for the possession and use of said firearms issued by the State of California, pursuant to the Business and Professions Code (B&P Code 7553). Firearms shall be used only in extreme cases of the threat of great bodily harm or death to self or other persons in the area, as stated in Section 8. All security personnel that will carry batons shall have a valid permit to do so, pursuant to the Business and Professions Code (B&P Code 7553).
