STAFF REPORT
The attached amendment to the Municipal Code was prepared at
the request of the Mayor to address the issue of tumbleweed
removal. This ordinance recognizes that mature tumbleweeds
reseed for future growth and, as such, the abatement of
mature tumbleweeds is more costly than the removal of sapling
tumbleweeds. This proposed ordinance declares that sapling
tumbleweeds are a public nuisance and requires that they be
hand removed prior to July 31st of each year. As proposed in
this ordinance, property owners will be responsible for hand
removal of sapling tumbleweeds.

4 WHEREAS, mature tumbleweeds create fire hazards;
5 WHEREAS, mature tumbleweeds reseed themselves for future
6 growth;
7 WHEREAS, the abatement of mature tumbleweeds is more costly
8 than the removal of sapling tumbleweeds;
9 WHEREAS, many parcels in the City of San Bernardino are
10 tumbleweed prone;
11 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
12 DO ORDAIN AS FOLLOWS:

SECTION 1.
Section 8.27.010 of the San Bernardino
14 Municipal Code is hereby amended to read as follows:
15
"A. The existence of weeds, dry vegetation of any type,
16
dead or diseased trees, dead or dry palm fronds,
17
fences in disrepair or broken, rubbish, refuse, and
18
dirt upon streets, road sides, sidewalks, parkways
19
between sidewalks and curbs, along fences, vacant
20
lots, easements or other property is hereby declared a
21
public nuisance, and the periodic removal thereof is
22
necessary to protect the health and safety of the
23
inhabitants of the City.

B. The existence of sapling tumbleweeds on private
25
property after July 31st of each year is hereby
26
declared a public nuisance.

C. As used in this chapter, the term 'weeds.' includes
5
recurrent and seasonal growth of weeds, weed seeds,
6
weed seedlings, sage brush, chaparral, tumbleweeds,
7
and any other brush or vegetation which attains such
8
extensive growth as to become, when dry, a fire
9
menace; poison oak and poison ivy or other Plants
10
which are noxious or dangerous; and dry grass,
11
stubble, brush, dead wood, litter or flammable
12
material which creates a fire hazard.
The terms
13
'rubbish' and 'refuse' include, but are not limited
14
to, empty containers, abandoned asphalt or concrete,
15
rubble, or waste materials of any kind.
16
D. Tumbleweed is the common name for the plant known as
17
Russian Thistle (Salsola Pestifer).
The tumbleweed
18 sapling is a red stemmed herb, which becomes prickly
19 and profusely branched into a dome-shaped plant."
