STAFF REPORT
The Council did previously authorize the proceedings to go forward for the formation
of a special assessment district to allow for the public financing of the subdivi-
sion improvements to be constructed within City subdivision Tracts 14184 and 14185.
subsequent thereto, the property owners were noticed as to their estimated assess-
ment in the manner as required by law and notice has been given as follows:

FILING MAP IN THE OFFICE OF THE COUNTY RECORDER
Adoption of the attached Resolutions will formally accept the works of improvement,
authorize their acquisition and confirm assessments in this Assessment District.
This action will impose liens on the property to represent their estimated indivi-
dual assessments. The next action in the proceedings will be the Resolutions taking
formal action authorizing the sale of bonds and accepting the purchase agreement.

RESOLUTION NO.

RESOLUTION OF THE CITY OF SAN BERNARDINO ACCEPTING THE
3 WORKS OF IMPROVEMENT AND APPROVING "AS-BUILT" CERTIFICATE FOR
ASSESSMENT DISTRICT 977A
4 WHEREAS, the COMMON COUNCIL of the CITY OF SAN BERNARDINO,
5 CALIFORNIA, has instituted proceedings pursuant to the provi-
6 sions of the "Municipal Improvement Act of 1913", being Division
7 12 of the Streets and Highways Code of the state of California,
8 for the construction and/or acquisition of certain public works
9 of improvement, together with appurtenances and appurtenant
10 work, in a special assessment district known and designated as
11 ASSESSMENT DISTRICT NO. 977A (hereinafter referred to as the
12 "Assessment District"); and,
13
WHEREAS, this legislative body did previously enter into an
14 agreement with the Property Owner, whereby certain public facili-
15 ties would be installed by Property Owner, and upon their comple-
16 tion and installation, said improvements would be financed and
17 purchased by this legislative body through the issuance of bonds
18 pursuant to the provisions of the "Improvement Bond Act of
19 1915", being Division 10 of said Code; and,

WHEREAS, at this time, the works of improvements (the
21 subject matter of the Purchase Agreement) have been completed,
22 and are all installed in place, and this legislative body is

24 approve the submitted "As-Built" Certificate.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
26 COUNCIL OF THE CITY OF SAN BERNARDINO THAT:

SECTION 1.
The above recitals are all true and correct.

SECTION 2;
the "AS-BUILT" CERTIFICATE, as set forth in the

final Engineer's "Report", is hereby approved, and said certifi-
4
cate sets forth the prices and quantities to be paid for certain
5
of the works of improvement to be financed and purchased by this
6 legislative body under these Assessment District proceedings.
7
SECTION 3.
The works of improvement as set forth in the
8
referenced Certificate are hereby aquired and accepted by this
9 legislative body.
I HEREBY CERTIFY that the foregoing resolution was duly
11 adopted by the Mayor and Common council of the City of San
