This ordinance added section 3.13.025 to the Municipal Code which permitted the Mayor and Council to waive or refund fees for any charitable, non-profit organization in a total amount not to exceed $25,000. This ordinance also established a deadline of April 12, 1990 to file for a request for refund of fees, and permitted any fees paid to the City between the period of January 1, 1988 through April 12, 1989 to be refunded by the Council at its discretion. Ordinance No. MC-653 was adopted on March 16, 1989, and established a procedure for requesting a waiver or refund of fees for charitable, non-profit organizations. This ordinance also permitted requests 'for refund of fees to be submitted to the City within 60 days after the payment of the fee. The Lighthouse for the Blind submitted the attached request for a refund of fees relating to a 20,000 square foot ad- dition to their school on Sierra Way. Although their initial request for reimbursement was for $29,908.40, a review of receipts as well as the time' frame limitations specified in these ordinances resulted in a revised reimbursement request of $21,637.06. An explanation is provided on the attached request relative to those fees not recommended for reimbursement. ed A. Said correspondence was designed to include only fees paid during 1989. At that time, Mr. Julian wrote me a note stating that would probably be the extent of reimbursement from the City of San Bernardino per Council Ordinance #653 which was adopted on March 13, 1989. Obviously, the major portion of our building fees were expended prior to 1989. From what I understand, as of today, the intent of #653 was much broader and not of such limited scope. In fact, I believe we are considering January of 1988 forward. Consequently, I have enclosed a complete itemization for fees paid to the City of San Bernardino for your perusal. Furthermore, I verify, under penalty of perjury, the forgoing is true and correct. I'm deeply grateful to all the fine people in City Hall who have "walked the extra mile" to make this dream come true for all the legally and totally blind students.
