The applicant requests that the Mayor and Council reconsider the denial and approve the tentative tract, BACKGROUND Tentative Tract No, 14604 is an application to subdivide one 15.21 acre parcel into 47 single-family lots located at the northeast corner of Magnolia Avenue and Ohio Avenue in the RL, Low Residential, General Plan land use designation, The tract was denied by the Planning commission at its regularly scheduled meeting of February 6, 1990 by a 5 to 1 vote, (See Exhibit B, Statement of Official Planning commission Action.) The Environmental Review Committee reviewed the Initial Study for the project on January 4, 1990 and recommended that at Mitigated Negative Declaration be adopted. The proposed Mitigated Negative Declaration was advertised and available for public review, To date, no comments have been received, The site is located in an area susceptible to high wind, high fire and biological and archaeological resource management overlay districts. APPEAL BASIS AND ANALYSIS The applicant is for denial and schools, basing the appeal requests review of upon inadequate findings Condition #24 regarding The Planning Commission denied this tract because inadequate infrastructure to support the development that has occurred or is scheduled to occur in the Verdemont Area has not been provided. The necessity of having installed or constructed adequate roads, drainage, fire station, landscaping, park facilities, and schools prior to development was cited as the problem with approving this and any other tracts in the area. This timing and financing issue has been a difficult policy matter the City has been trying to resolve. A Mello- Roos Community Facilities Assessment District has been the latest proposal to finance the needed improvements. The construction of these improvements is proposed to be phased. The timing and extent of each phase would be critical to knowing what would be an appropriate condition of approval for this tract. In addition, there has been a concern raised about Condition #24, which limits construction start of homes until construc- 75-0264 Appeal of Planning Commission Denial of T.T. No. 14604 Mayor and Council Meeting of 3/5/90 Page 3 tion contracts for the schools have been awarded and occu- pancy of the homes could not occur until the schools were completed, The objection is that the city does not control when or where the schools might be built, However, this is the main point of the condition. The timing of when the development comes "on-line" should be closely coordinated with the timing of when the schools come "on-line." CONCLUSION The tract can be participate in the infrastructure, and development coming infrastructure comes have been amended in approved, if properly conditioned to financing plan for providing the needed if conditioned as to the timing of "on-line" when the needed surrounding "on-line." We believe ample mitigation measures were incorporated in the project and the conditions of approval to mitigate all reasonable concerns. We do request review of Condition 24 regarding schools, since this condition goes beyond the ability of the both the developer or the City to ensure. To address the concerns regarding schools you might indicate that the School District shall indicate that adequate facilities are available to serve the students from this project. I understand that this was a concern expressed by the Planning Commission on a previous project. However, as your staff report indicates, the fact is that the School District has already indicated that the only mitigation required is payment of school fees. If there are additional concerns or issues to address, please advise us, We have enclosed our check #3661 in the amount of $100.00 payable to the City of San Bernardino, for the appeal fee. The requested subdivision is consistent with the m~n~mum lot development standards of the RL, Residential Low, land use designation and is consistent with the General Plan adopted by the Mayor and Common Council on June 2, 1989, in that the density of the proposed tract is 2.83 dwelling units per gross acre while the plan will allow 3.1 dwelling units per acre, however, the proposed tract is inconsistent with the existing pattern of development in that the density of the surrounding area is one (1) dwelling unit per acre. 2. All lots created meet Municipal Code requirements in that they and each rectangular lot has a minimum width of 80 feet (88 feet on corner lots) and depth of 100 feet. The irregular lots meet Code requirements. 3. The land use designation allows a density of 3.1 units per gross acre and requires a minimum lot size of 10,800 square feet, SITE LOCATION The 15.21 acre site is located at the northeast corner of Magnolia Avenue and Ohio Avenue, in the Verdemont area. The site has a frontage on Magnolia Avenue of approximately 704.21 feet and a frontage on Ohio Avenue of approximately 1,026.85 feet (see Attachment H, Location Map). MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE The proposed project and in conformity Attachment A, is consistent with with the General the Municipal Code Plan as shown in CALIFORNIA ENVIRONMENTAL QUALITY ACT The Initial Study was prepared by staff and presented to the Environmental Review Committee (ERC) on January 4, 1990. The ERC found that no significant impacts will result from the project and recommended a Negative Declaration. The Negative Declaration was advertised and available for public review from January 10, 1990 to January 24, 1990. To date no comments have been received. If comments are received, they will be presented to the Planning Commission at the February 6, 1990 Planning commission meeting (s,ee Attachment E, Initial Study), ANALYSIS site Characteristics The 15.21 acre site is currently vacant with the exception of eucalyptus trees along the northern, southern and western property lines and one eucalyptus tree near the center of the project site. The property slopes approximately seven to nine percent to the south and has two natural drainage swales on the eastern third of the property that traverse the site to the south. "" .. ,. Magnolia Avenue is paved but is not improved with curb, gutter or sidewalks. Ohio Avenue is an unimproved dirt road, Surrounding Area The property to the east and south are vacant. Scattered single family residences and vacant land are located to the north and west of the proposed site, Density and General Plan The General Plan allows a maximum density of 3.1 dwelling units per acre with a minimum lot size of 10,800 square feet. The project proposes a density of 2.83 units per acre with a minimum lot size of 10,800 square feet. Access and Circulation The primary access to the site will be from Magnolia Avenue. Lots numbered one through six have double frontages, however, access to these lots will be restricted to an interior street and a six foot perimeter wall will be placed adjacent to Magnolia Avenue. Secondary access will be provided via Ohio Avenue to Little League Drive and to Palm Avenue. The Engineering Department is requiring a minimum 24 foot wide pavement from the site to Palm Avenue and from the site to Little League Drive should this proposal develop prior to other approved tracts on Ohio Avenue. Environmental Concerns The project is located within an area susceptible to High Wind, High Fire and Greenbelt Zone B. . The project will comply with all applicable Verdemont Area Plan Standards for development located in these zones (see Attachment C, Conditions). The site is located within the Chestnut Storm Drain Assessment District. The developer will be required to comply with Resolution No. 89-116 for development of the site. The site is located in the Verdemont area and is also subject to the development fee program. AGENDA ITEM HEARING DATE PAGE r """I resolution and fee program were found to be necessary for the health and safety of existing and future Verdemont residents (see Attachment C, Standard Requirements Nos. 22,23, and 24 and Attachment D, Standard Requirements). Biological Resources The site is located in the Biological Resource Management Overlay District. A Biological Assessment was prepared by Joe Gorman, PhD, Associates in December of 1989 which found no evidence of any sensitive or endangered species of plants or animals. An arborist report was prepared by Knapp Associates in November, 1989 at the request of the Parks and Recreation Department. The site contains approximately seventy-nine trees. The report recommended the preservation or relocation of an Olea Eurooaea (olive) tree. The report recommends replacing the other trees due to their overall poor condition and vitality. The Parks and Recreation Department and the Environmental Review Committee agrees with this conclusion. To mitigate the loss of these trees and the preservation of the olive tree, the developer has prepared a Mitigation Monitoring Program (see Attachment F). The Parks and Recreation Department has included as a part of their conditions a requirement for a follow-up report from the arborist (see Attachment E, Initial Study). Archaeological Resources The site is within an area identified by the General Plan as having a potential archaeological resources. A cultural assessment was performed by victor C. De Munck in October, 1989. No evidence of any cultural or historical remains were discovered. A condition has been included that, if subsurface cultural resources are found during development, a qualified archaeologist shall be consulted to evaluate these resources and shall be empowered to halt construction until appropriate data recovery/protection measures have been implemented (see Attachment C, Conditions). COMMENTS RECEIVED All City Departments reviewed the proposal at the Environmental Review Committee Meeting. The Engineering Division and Parks and Recreation Department have attached ..... The San Bernardino Unified School District commented that the project would be subject to school facility fees as established by the Board of Education. The united States Postal Service commented that the developer is encouraged to show easements or other mapped provisions for the placement of centralized mail delivery units. CONCLUSION Tentative Tract No. 14604 meets all of the development standards of the Municipal Code and is consistent with General Plan and the Subdivision Map Act. Impacts associated with the project will be mitigated and reduced to a level of insignificance. A Mitigation Monitoring Program has been prepared to ensure that all mitigation required in the Initial Study will be complied with. Infrastructure timing concerns have been conditioned to approval of the tract. RECOMMENDATION It is recommended that the Planning commission: 1. Adopt the Mitigated Negative Declaration: and, 2. Approve the Mitigation Monitoring/Reporting Program (Attachment F): and, 3. Approve Tentative Tract No. 14604, subject to the attached Findings and Fact (Attachment B), Conditions of Approval (Attachment C) and Standard Requirements (Attachment D). The requested subdivision is consistent with the minimum lot development standards of the RL, Residential Low, land use designation and is consistent with the General Plan adopted by the Mayor and Common council on June 2, 1989, in that the density of the proposed tract is 2.83 dwelling units per gross acre while the plan will allow 3.1 dwelling units per gross acre. 2. The criteria for preservation of trees involves a multi-step process of identifying the trunk condition, growth rates, structure, presence of insects and disease, crown develop- ment, and most important the life expectancy. section # 1: North - South Windrow. Approximately twenty one (21) Eucalvptus globulus (blue gum), which form a north - south windrow. Trees have ran- dom regrowth from cut stumps. Existing trees are not sui table for preservation, due to lack of vi tali ty and proper cultural care. section I 2: East - West Windrow. This windrow consists of six (6) Eucalvptus alobulus (blue gum), and one ( 1 ) Eucal vptus camaldulensis (red gum). Trees have regrowth from cut stumps, fire damage and decayed basal area. Existing trees are not sui table for preservation or relocation, due to lack of vitality and proper cultural care. 1 section' 3: East - West Windrow. This windrow consists of approximately fifty (50) trees, which are a combination of Eucalvptus alobulus (blue gum), Eucalv9tus camaldulensis (red gum), and one (1) Qlgg europaea (olive). Of the existing trees, only the olive tree is suitable for preservation or relocation. The eucalyptus are not suitable for preservation, due to lack of vitality and proper cultural care. (regrowth). Conclusions: In my opinion, the overall poor condition and vitality of the eucalyptus trees render them unsuitable for preser- vation or relocation. I recommend that all three (3) windrows be replaced. The olive tree is suitable for preservation or relocation. Again, this is a preliminary report and further site in- s~ections maybe necessary. The chart shall list each mitigation measure, monitoring or reporting action and be ruled into columns that are designed to record responsible agency, dates of completion, inspector or other certifying person and the person recording the information. Biological Resources Mitigation Measures. A number of existing trees may be affected by the construction of this project. An arborist report has been submitted to the city for review and comment. Based on that report and field survey and analysis (parks and recreation, planning), conditions of approval will require that a program be implemented to preserve, relocate and/or replace the existing stands of trees. Biological Resources Reporting/Monitoring Action. Upon final acceptance of the developer's work in implementing a program to preserve, relocate and/or replace the existing stands of trees the Parks and Recreation Department shall notify the City Planning Department, in writing of compliance. The Planning staff shall retain such notice in the project file and annotate the file indicating compliance with the measure. CONCLUSION This Mitigation Monitoring/Reporting Program shall be retained by the City in the Planning Department project file for Tentative Tract 14604. As various mitigation measures are fully implemented their completion should be documented by appropriate notation on the checklist chart provided specifically for this project.
