Section 12.04.055 is hereby added to the San Bernardino Municipal Code to read as follows: "12.04.055 Encroachment fee for utility lane closure The Mayor and Common Council of the City of San Bernardino 9 may impose a fee for encroachments for utility lane closures. Such fee shall not apply between the hours of six o'clock p.m. and six o'clock a.m. or on weekends or legal holidays." SECTION 2. This ordinance is an urgency ordinance necessary for the immediate preservation of the public health, safety and welfare in order to protect the traffic safety of the 15 citizens of San Bernardino, by encouraging those utilities which 16 need to make street encroachments to do such work at hours of 17 lesser traffic congestion. When heavy traffic is required to use 18 fewer lanes than the normal design provides, the chance of 19 accidents and injuries are greatly increased, and therefore the 20 performance of such work during off hours will increase the 21 22 health and safety of the citizens of the City of San Bernardino. / / / / / / / I I / / / / / / / / / DAB/ses 1 December 5, 1989 23 24 25 26 27 28 10 11 12 13 14 15 1 AN URGENCY ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION 12.04.055 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING 2 TO AN ENCROACHMENT FEE FOR UTILITY LANE CLOSURE 3 I HEREBY CERTIFY that the foregoing ordinance was duly 4 adopted by the Mayor and Common Council of the City of San 5 Bernardino at a meeting thereof, held on the 6 day of , 1989, by the following vote, to wit: 7 AYES: Council Members 8 9 NAYS: ABSENT: City Clerk The foregoing ordinance is hereby approved this day of , 1989. 16 17 W.R.
