STAFF REPORT
Bids for this project were received at 2:00 p.m. on
Tuesday, 1-16-90.
A total of three bids were received, ranging from
$17,183.85 to $22,578.00. The low bid of $17,183.85 was $16.15
below the Engineer's Estimate of $17,200.00.
Listed below is the total estimated project cost, based
upon the actual low bid price.

An amount of $20,000 has been allocated in the Traffic
System Fee Fund, under Account No. 250-000-41803, Southeast
corner of Gilbert Street and Waterman Avenue, to finance the
cost for these improvements.
At their meeting of 9-28-89, the City's Environmental
Review Committee determined that this project is categorically
exempt from provisions of the California Environmental Quality
Act.
We recommend that a contract be awarded to the low
bidder.

1 RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO BOB BRITTON, INC. FOR STREET IMPROVEMENTS AND
3 RELOCATION OF TRAFFIC SIGNAL AT GILBERT STREET AND WATERMAN
AVENUE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Bob Britton, Inc. is the lowest responsible
7 bidder for Street Improvements and relocation of Traffic Signal,
8 at Gilbert Street and Waterman Avenue, in accordance with Plan
9 No. 7907, for the total amount of $17,183.85, and a contract is
10 awarded to said bidder accordingly, but such award shall be
11 effective only upon the contract being fully executed by the
12 parties; all other bids therefore are hereby rejected; and the
13 Mayor is hereby authorized and directed to execute said contract
14 on behalf of the City; a copy of the contract is attached hereto,
15 marked Exhibit "A" and incorporated herein by reference as fully
16 as though set forth at length.

SECTION 2. This contract and any amendment or modifica-
18 tions thereto shall not take effect or become operative until
19 fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No
21 oral agreements,
amendments,
modifications or waivers are
22 intended or authorized and shall not be implied from any act or
23 course of conduct of any party.

SECTION 3.
This resolution is rescinded if the parties
25 to the contract fail to execute it within sixty (60) days of the
26 passage of this resolution.
