Recommended motion:
1. That the City Administrator be authorized to enter into an agreement for profession-
al services with Pavement Management Systems, said agreement being estimated at
$112,000 to $140,000.
2.
That the City Administrator be directed to negotiate with the Redevelopment Agency
for recovery of 66% of the total cost on the basis of benefit to RDA project areas
and arterial streets serving multiple areas. 7

STAFF REPORT
As part of a lawsuit initiated by the Water Department against San Ber-
nardino Valley Water Conservation District, staff was asked to determine
the extent and dollar amount of street damage that could have been
caused by high ground water resulting from the recharging and management
practices of the District.
Initial estimates are in the range of $37 million dollars. In
subsequent meetings with legal staff, it became apparent that more
detailed analysis would be necessary for presentation in court.
In-house staff lack the necessary equipment, personnel and time to
prepare the required data and analysis and it is recommended that
outside "experts" be used for presentation of this data in court.
The legal firm preparing the case has contacted PMS, a firm that
specializes in gathering data relative to pavement conditions, and has
presented data in court on similar issues. They provided a first
estimate of $231,000.00 to perform the work. At follow-up meetings
involving Public Works Staff, the legal firm of Gibson, Dunn and
Crutcher and representatives of PMS, a program was outlined in which the
cost could be reduced, based on field inspection and observation, to a
range estimated at $112,000.00 to $140,000.00. If successful in the
action, the City could recover several millions of dollars for street
repair. In the even the suit is lost, the data obtained would still be
very useful to the City for preparing the Capital Improvement Program
and Street Resurfacing Programs.
A review of the streets to be tested shows 66% are arterial streets with
the remaining streets being made up of 25% secondary arterials, 1.6%
collectors and 6.84% local streets. The arterial streets serve several
RDA project areas including Southeast Industrial, Tri-City, Uptown,
Central City South, South Valle, Northwest, Meadowbrook-Central and
Central City North. In view of the overall benefit to the project areas
from the improvements of the arterial street system, it is felt that the
RDA project areas should absorb the costs.
