On April 24, 2006 the Personnel Committee recommended this item for approval by Mayor and Council. Recommended Motion: 1. Back2round: The City of San Bernardino's workers' compensation program is self-insured and self- administered. The Workers' Compensation Manager is responsible for managing this division which currently has two (2) Workers' Compensation Specialists and two (2) Workers' Compensation Claims Assistants. We currently have a vacancy in the Specialist position and must fill the position under the new requirements of a legal mandate. As a result of Assembly Bill 1252 (Matthews), on February 22,2006, the City of San Bernardino was required to certify all claims staff to meet minimum standards of training and/or experience in order to adjust workers' compensation claims. This certification must be reported to the Insurance Commissioner on or before July I st of each year. The regulations specify both the training and experience required for adjusters. Failure to meet training or experience requirements will result in an inability to adjust workers' compensation claims in California. The City's staff must meet these standards in order to continue to self-administer our program. In an effort to retain current staff members and maximize the recruitment for the current vacant position a classification/compensation study was completed. The study indicates that both positions are more then 20% below market and the Adjuster is 45% below market. Additionally, due to the changes in the State law by Senate Bill 899 effective in 2004, the City's Workers' Compensation Division has experienced a significant increase in the number of deadlines that must be met. Labor Code 4610 requires that medical treatment decisions must be made within five (5) working days. The only exception to this is when additional medical information is necessary for clarification, in which case a decision must be made within fourteen (14) days. The new law also requires that medical billing be paid within sixty (60) days. Since 2000, the City has added 311 employees who are covered by workers' compensation insurance, which has caused an increase in workers' compensation claims handled by the Division. In 2000, the Workers' Compensation Division handled a total of 431 claims by year-end compared to a current total of 551 open claims. This has also substantially increased the number of bills processed by Division staff. The following changes/additions are recommended: Reclassifv Workers Compensation Specialist to Workers' Compensation Adiuster Workers' Compensation Specialist is responsible for determining the validity of each worker's compensation claim. They establish a case reserve, approve and process all workers' compensation benefits, may hire investigators or other professionals and may negotiate settlements of claims within the recommended authority and approval of the Mayor and Common Council. These positions are responsible for the monitoring of claims expenditures, communication with physicians, supervisors, employees and attorneys regarding illnesses or injuries related to employment Workers' Compensation Adjusters will now be required to have five (5) years (previously two (2) years) in the last eight (8) years of on-the-job experience adjusting California workers' compensation claims or supervising claims adjusters handling workers' compensation claims. In addition they must have successfully completed the Self-Insurance Exam written examination and have either worked as a claims adjuster or supervisor of workers' compensation claims continuously since passing the examination, or passed the exam within the previous five years. Another requirement is that the employee must complete 30 hours of training every two years. The current staff member was pro-active and meets the newly mandated requirements. After surveying other cities that self-insure and self-administer workers' compensation functions it was found that this position is 45% below the average (survey attached). Reclassify Workers' Compensation Assistant to Workers' Compensation Medical Only Adiuster The Workers' Compensation Medical Only Adjusters are responsible for determining the validity of a workers' compensation claim involving medical workers' compensation benefits only, as defined under Labor Code section 4600. The medical only claims adjuster may establish medical treatment reserves, approve and process medical benefits, and negotiates settlement of medical benefits claims. This adjuster will be responsible for the immediate supervision of medical only benefits. Medical Only Adjusters will now be required to have at least three (3) years in the past five (5) years of on-the-job experience adjusting California workers' compensation medical-only claims. They also must complete 20 hours of training every two years (not previously required). Both employees have been pro-active and meet the minimum requirements. Survey results showed this position 20.9% below average (survey attached). Add One (1) Account Clerk II Due to the increased workload from changes in workers' compensation law and increased number of employees eligible for workers' compensation benefits, the amount of staff time needed for processing bills and claims has increased dramatically. Current staffing levels do not adequately allow for the timely and accurate processing of bills and claims. To address this we are recommending the addition of one Account Clerk II position. As part of processing bills and claims, the Account Clerk would be responsible for reviewing bills for accuracy, making sure they are properly coded for the type of injury and making sure all charges are reasonable and necessary. Failure to properly pay bills timely could result in extensive penalties as outlined in Labor Code 4603.2. (B) (2); the penalty for the delay of payments after a 60 working-day period shall be increased by 15 percent together with interest at the same rates as judgements in civil actions retroactive to the date of receipt of the bill. In comparison to other similar size Cities with self-insured, self-administered workers' compensation insurance, both Pomona and Riverside each have one additional clerical position assigned to workers' compensation billing functions, as we are now requesting. Financial Impact: Reclassify two (2) positions of Workers' Compensation Specialist, range 1387, $3059-$3718 to Workers' Compensation Adjuster, range 1449, $4167-$5065 per month. The Human Resources Department will require an increase of$58,700 to the Workers' Compensation Division budget for the FY 2006-07 to reflect the increase in salary and benefits. Since Workers' Compensation is an Internal Service Fund, this increase in budget will be charged back to City Departments Recommendation: I. SUMMARY DESCRIPTION Under general supervision, examines and adjusts claims for Workers' Compensation benefits; monitors claim expenditures; communicates with physicians, supervisors, employees and attorneys regarding illnesses or injuries related to employment; and performs related work as required. ORGANIZATIONAL RELA TIONSIDPS The class of Workers' Compensation Specialist is a professional-level claims adjusting class in the Risk Management Division. Supervision is received from the Risk Management Coordinator. REPRESENTATIVE DUTIES The following duties are typical for positions in this classification, Any single position may not perform all of these duties and/or may perform similar related duties not listed here: I. Provides courteous and expeditious customer service to the general public and City department staffs. 2. Performs specialized duties involved in the coordination and control of Workers' Compensation procedures; reviews and records injury claims of City employees which have occurred in the performance of duties for the City; makes recommendations regarding the processing of work injury claims by employing departments; examines claims to determine if they comply with applicable laws, rules and regulations of the State of California; reviews injury reports for completeness and consistency. 3, Develops documentation by requesting substantiating reports from physicians, departments and witnesses; resolves discrepancies in data; requests investigations to verify questionable claims data; informs employees injured on the job of their rights and benefits under the Workers' Compensation laws; advises departments regarding procedures and reporting deadlines involving work injuries. 4. Maintains financial control on open files; monitors medical treatment; establishes case reserves based on judgment and experience; reviews all physicians' reports, analyzing medical diagnoses and prognoses; confers with physicians, hospital officials, attorneys, departments and employees to determine status of cases. 5. Authorizes payment of medical bills, temporary disability, permanent disability and death benefits; coordinates with payroll, return to work and absentee information involving employees absent due to an on-the-job injury or illness; supervises clerical employees engaged in processing work injury claims; maintains permanent files and records of claims data and benefits issued. 6. Prepares cases for litigation; arranges special investigative medical examinations; attends Workers' Compensation Appeals Board hearings; researches pertinent statutes as necessary; and rates permanent disability claims in accordance with the Labor Code, the Schedule for Rating Permanent Disability and case law. 7. Provides assistance to various human resources staff in answering phones, providing information regarding job openings and distributing job applications. 8. Routinely adheres to and maintains a positive attitude towards City and Department goals; and performs related work as required. SUMMARY DESCRIPTION Under general supervision, performs a variety of specialized and responsible accounting work of average difficulty in connection with the preparation, review and maintenance of financial and statistical records and processing of payroll; and perfonns related work as required. ORGANIZATIONAL RELATIONSHIPS The class of Account Clerk II is the journey level in the account clerical series. Supervision is received from an accountant or supervising personnel of the assigned department. REPRESENT A TIVE DUTIES The fol/owing duties are typical for positions in this classification. Provides courteous and expeditious customer service to the general public and City department staffs. 2. Perfonns account record keeping and analysis of average difficulty in an assigned area of responsibility; researches packing slips and invoices and obtains authorization for payment; checks prices, extensions, tax and discounts; codes invoices for payment; batches documents for computer input; enters account and purchase order numbers, vendor numbers, amounts of payables and related data to computer tenninal. 3. Assembles accounts payable documents for approval; calculates unit cost of stock; audits summaries, enters to computer and prepares worksheets; enters journal entries and edits data processing print- outs; posts infonnation to a variety of records, and controls and balances records; prepares fmancial related reports; audits documents for accuracy of computation and completion. 4. Collects, sorts and posts bills, invoices, receipts and other data; posts, checks balances and adjusts accounts; makes arithmetical calculations and checks various statistical and accounting tables and reports; reconciles records to established balances, identifying and/or resolving discrepancies; reviews invoices and receiving reports for adequacy and accuracy and prepares vouchers and checks for payment of obligations. 5. Generates request for payment letters for NSF checks; records and receipts all payments for NSF checks; distributes a copy of payment to appropriate department; maintains and files payment receipts; prepares non payments for sending to collections. 6. Accepts. applications for new customer services and prepares appropriate work orders for departments; provides assistance to low income applicants in processing applications; inputs data to establish accounts; bills for services; corrects billing errors and closes accounts by means of computer tenninal; audits bills; stuffs envelopes; prepares listings of past due accounts; answers customer complaints, referring to supervisor as appropriate; prepares handwritten materials; prepares journal vouchers. 7. Calculates and verifieS all infonnation relating to City tax exemptions; generates reports of City tax exemption status; processes requests for payments for refunds of City tax; calculates City tax charged in error on utility bills. 8. Inputs payroll time sheets for employees; types payroll checks; processes payroll wage garnishments; posts vacation, sick leave, holiday, comp time, military leave and overtime accrued; requests warrants for payroll deduction payments; generates fonns and reports for various payroll records. Accepts and processes paperwork for the administration of US Passport applications. 11, As assigned, collects, balances, prepares report and submits to central cashier daily revenue taken in by the department. 12.
