Authorize the Director of Finance to amend the FY 05/06 Budget by transferring $156,600.00 from Account No. 129-367-5504-7383 (SS04-64) "Pavement Rehabilitation for Two Lanes & 24-inch Gas Line" to Account No. 129-367-5504-7378 (SS04-65) "Safe Routes to Schools ADA Improvements at Various Locations", and 2. Authorize the Director of Finance to amend the FY 05/06 Budget by transferring $156,600.00 from Unallocated Infrastructure Loan Bank Contingencies to new Account No. 240-379-5504-7383 (SS04-64) "Pavement Rehabilitation for Two Lanes & 24-inch Gas Line", and 3. Adopt Resolution. Description: y,-Cent Sales Tax Finance: Council Notes: R ey). ,;l{))o- J/ h Agenda Item No. l3 J /I/f}{p CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION Staff Report Subject: Resolution awarding a contract to Conengr Corporation for Construction of ADA Access Ramps and Sidewalk at Various Locations, (SS04-65) Safe Routes to Schools, per Plan No. 11023 and authorization for the Director of Finance to amend the FY 05/06 Budget. Background: On August 15, 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06 Capital Improvement Program (CIP), for the Construction of ADA Access Ramps and Sidewalk at Various Locations, (SS04-65) Safe Routes to Schools, per Plan No. 11023. This project consists of the following: I. Removal of curb-gutter,_ sidewalk, asphalt and existing ramps. 2. Construction of curb-.gutter, sidewalk, ADA ramps, and asphalt. 3. Replacement of striping, signage and roadway improvements. This contract is for "Safe Routes to Schools" project to eliminate barriers within the public right-of-way in the vicinity of public schools. Areas to receive improvements have been determined, in part, through the School of the Month program. This program has involved meetings at a different school each month between staff and school officials to identify problem areas around the school. One of the issues discussed in the School of the Month meetings is public improvements including, but not limited to, improvements of safe routes to school for the students. Schools, which participated in the application for the "Safe Routes to Schools" grants for this project, were Arrowhead Elementary School at the northwest comer of 38th Street and Genevieve Street, Roosevelt Elementary School at the northeast comer of Terrill Avenue and Magnolia Avenue, North Verdemont Elementary School, 3557 West Meyers Road and Burbank Elementary School, 198 West Mill Street. The plans and specifications for this project have been completed and bids were received on February 28, 2006. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge, Construction Bid Board, Construction Data Hot Sheet, Reed Construction Data and Bid America, Construction Bid Source, the City's web sites, and with the San Bernardino Area Chamber of Commerce. Staff is proposing to transfer the funds from Project No. SS04-64 "Pavement Rehabilitation for Two Lanes & 24-inch Gas Line". There will be no impact to Project No. SS04-64 because funding for this project will be backfilled from un allocated I-Bank loan contingencies. Recommendation: I. Authorize the Director of Finance to amend the FY 05/06 Budget by transferring S 156,600.00 from Account No. 129-367-5504-7383 (SS04-64) "Pavement Rehabilitation for Two Lanes & 24-inch Gas Line" to Account No. 129-367-5504-7378 (SS04-65) "Safe Routes to Schools ADA Improvements at Various Locations", and 2. BE IT RESOLVED BY THE MAYOR AND COM:\ION COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 8 SECTIO~ 1. Conengr Corporation, 1306 Monte Vista Avenue, #9, Upland, CA 9 10 11 12 13 14 15 16 9 I 786, is the lowest responsible bidder for Construction of ADA Access Ramps and Sidewalk at Various Locations, (SS04-65) Safe Routes to Schools, per Plan No.1 1023. A contract is awarded accordingly to said bidder in a total amount of $288,933.90, with a contingency amount of $43,340.00, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set 17 forth at length. SECTIO~ 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTIO~ 3.
