Roll Call Roll call was taken by City Clerk Clark with the following being present: Mayor/ Chairman Valles; Council Members/Commissioners Estrada, Longville, McGinnis, Derry, Kelley, Johnson; City Attorney Penman, City Clerk Clark, City Manager Wilson. Absent: Council Member/Commissioner McCammack. Invocation/Pledge of Allegiance The invocation was given by David Rhone of First Church of the Nazarene, followed by the pledge of allegiance, led by Maggie Willis, granddaughter of Mayor -elect Morris. Presentations were made to Mayor Judith Valles and Councilwoman Susan Longville in honor of their many years of dedicated service to the City. Oaths of office were administered to Mayor Patrick J. Morris, Councilwoman Esther Estrada, Councilman Dennis J. Baxter, and Councilman Neil Derry, followed by a reception. Closed Session Announcement City Clerk Clark announced that during closed session a motion was made by Council Member/Commissioner Estrada, seconded by Council Member/ Commissioner Derry, that the City Council approve the third amendment to the Employment Agreement between Fred Wilson and the City of San Bernardino, effective March 6, 2006, for the position of City Manager, for a period of one year. 3 03/06/2006 The motion carried by the following vote: Ayes: Council Members/ Commissioners Estrada, Baxter, McGinnis, Derry, Kelley, Johnson. Reading of Resolutions & Ordinances Deputy City Clerk Sutherland read into the record the titles of all the resolutions and ordinances on the regular agenda of the Mayor and Common Council and Community Development Commission. 2. Appointment - Jerry Martin - Board of Building Commissioners - Council Member/Commissioner Baxter Council Member/Commissioner Estrada made a motion, seconded by Council Member/Commissioner Longville, that the appointment of Jerry Martin to the Board of Building Commissioners, as requested by Council Member/Commissioner Baxter, be approved. Waive Full Reading of Resolutions & Ordinances Council Member/Commissioner Johnson made a motion, seconded by Council Member/Commissioner Estrada, that full reading of the resolutions and ordinances on the regular agenda of the Mayor and Common Council and Community Development Commission, be waived. Claims & Payroll Council Member/Commissioner Johnson made a motion, seconded by Council Member/Commissioner Estrada, that the claims and payroll and the authorization to issue warrants as listed on the memorandum dated February 28, 2006, from Barbara Pachon, Director of Finance, be approved. Personnel Actions Council Member/Commissioner Johnson made a motion, seconded by Council Member/Commissioner Estrada, that the personnel actions, as submitted by the Chief Examiner, dated March 2, 2006 in accordance with Civil Service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified. Resolution of the Mayor and Common Council of the City of San Bernardino approving the destruction of certain records no longer required to be maintained by the San Bernardino City Attorney's Office. MC-1218 - An Ordinance of the City of San Bernardino amending Chapter 19.06 (Commercial Districts), Sections 19.06.020, Table 06.01 (K) (5) and (14), Section 19.06.030, Table 6.03 and Section 19.06.030 (2) of the San Bernardino Municipal Code (Development Code) related to mixed -use commercial and residential development (including Artist Colony and Combination Residence/Office). RES. 2006-65 - Resolution of the Mayor and Common Council of the City of San Bernardino approving the Final Map for Tract Map No. 16496, located at the northwest corner of Bronson Street and Portola Avenue in the RS, Residential Suburban land use district, accepting the public dedications as set forth on said map; and authorizing execution of the standard form of agreement for the improvements in said subdivision, with time for performance specified. RES. 2006-66 — Resolution of the City of San Bernardino implementing a Memorandum of Understanding between the City of San Bernardino and employees in the Fire Safety Unit represented by the San Bernardino City Professional Firefighters. Council Member/Commissioner Johnson made a motion, seconded by Council Member/Commissioner Estrada, that said resolution be adopted; and that the Director of Finance be authorized to amend the FY 2005/06 budget to transfer $25,100 from the General Government budget (001-092-5011) to the Fire Department budget. RES. 2006-67 — Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the purchasing manager to issue a purchase order to Aardvark Tactical in an amount not to exceed $77,540 for threat level III ballistic vests for MET and Vice -Narcotic officers per Bid F-06-18. Council Member/Commissioner Johnson made a motion, seconded by Council Member/Commissioner Estrada, that said resolution be adopted. RES. 2006-68 — Resolution of the Mayor and Common Council of the City of San Bernardino ratifying submittal of the application for Waste Tire Cleanup and Amnesty Event grant funds from the California Integrated Waste Management Board. Receive and file Annual Audit of the Water Department's Water and Sewer Utilities for Fiscal Year ending June 30, 2005 Council Member/Commissioner Estrada made a motion, seconded by Council Member/Commissioner McGinnis, that the Mayor and Common Council receive and file the Annual Audit of the Water Department's Water and Sewer Utilities for the fiscal year ending June 30, 2005. Salary Adjustment for Dispatchers I & II, Dispatcher Supervisor, and Police/Fire Communications Managers Council Member/Commissioner Estrada made a motion, seconded by Council Member/Commissioner Baxter, that the Mayor and Common Council: Adjust the salary range for Dispatcher I, Range 1366, $2,755-$3,348/month to Range 1382, $2,984-$3,627/month; Adjust the salary range for Dispatcher II, Range 1385, $3,029-$3,681/month to Range 1401, $3,280-$3,987/month; Adjust the salary range for Dispatch Supervisor from Range 2423, $3,660- $4,449/month to Range 2439, $3,965-$4,819/month; Adjust the salary range for Police Communications Manager, Range 2451, $4,209- $5,116/month to Range 2467, $4,559-$5,541/month; Adjust the salary range for Fire Communications Manager, Range 2441, $4,004- $4,867/month to Range 2457, $4,337-$5,272/month; and Authorize the Director of Human Resources to update Resolution Nos. 6413 and 2005-428 to reflect these actions. Set public hearing - Monday, March 20, 2006 at 4 p.m. - to discuss proposed development impact fees (Continued from February 6, 2006) Council Member/Commissioner Derry made a motion, seconded by Council Member/Commissioner Kelley, that the Mayor and Common Council set a public hearing for 4:00 p.m. Monday, March 20, 2006, in the Council Chambers, to discuss proposed development impact fees; and that staff be directed to prepare the appropriate resolution(s) and/or ordinance(s) to implement the proposed new and adjusted impact fees, and to proceed with the studies to update the storm drain and Verdemont infrastructure impact fees. FIRST READING Council Member/Commissioner Estrada recommended that the Mayor and Council hold a workshop to discuss the implications of the new City Charter. Mayor Morris agreed, stating that a workshop would be scheduled before the next Council meeting. Council Member/Commissioner Baxter made a motion, seconded by Council Member/Commissioner Estrada, that said ordinance be laid over for final adoption. Cable Canyon Road - Councilman Kelley Council Member/Commissioner Kelley provided a brief history of Cable Canyon Road. Steve Smith, Cable Canyon Road, San Bernardino, CA, stated that since Cable Canyon Road was flooded and the pavement covered with dirt, they have seen an increase in crime in that area. He stated that they have run across people on that road who have been in possession of drugs, stolen property and stolen mail, and there have been several instances where individuals have been under the influence of drugs and/or alcohol. Mr. Smith stated that people have been found camping in 10 03/06/2006 22 the destroyed area of the KOA Campground, and on two separate occasions items were illegally dumped, blocking the road for several hours. Iris Lee, 8150 Cable Canyon Road, San Bernardino, CA, stated that the road is very rocky and bumpy, and every time it rains she wonders if she will be able to go to work. John Gordon, 1631 Cable Canyon Road, San Bernardino, CA, provided a brief history of the area. Stan Smith, 8154 Cable Canyon Road, San Bernardino, CA, stated that Cable Canyon is a public road that was part of the County until it was annexed into the City. He stated that when he built his home in 2003, he was not told that it was a private road. Mr. Smith stated that the road has always been paved and the street sign says "Cable Canyon. " He stated that the residents are only asking that the road be returned to its original condition. Susan Smith, 1376 Cable Canyon Road, San Bernardino, CA, stated that when the freeway was built in 1957, the County adopted this road and maintained it until the area was annexed into the City. She stated that after Cable Canyon Road was flooded out in 2003, the Federal Emergency Management Agency (FEMA) stated that they would not provide assistance due to the fact that it is a public road. Mark Lancaster, Deputy Director/City Engineer, stated that his research had indicated that Cable Canyon is a private road. He stated that there is a sign at the end of the road, near the I-215 Freeway, that indicates that it is not a maintained public road. Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Derry, that City staff be asked to find a solution and the funding resources necessary to resolve this issue. The motion failed by the following vote: Ayes: Council Members/ Commissioners Derry, Kelley. Nays: Council Members/Commissioners Estrada, Baxter, McGinnis, Johnson. Absent: Council Member/Commissioner McCammack. An Ordinance of the City of San Bernardino, California, adding Chapter 13.25 of the San Bernardino Municipal Code entitled Spreading or Extraction within the Management Zone. FIRST READING Bob Reiter, San Bernardino Valley Municipal Water District General Manager/ Chief Engineer, 1350 South "E" Street, San Bernardino, CA, thanked City staff, special counsel, and the many consultants who worked with the District to address the plume problem, and he stated that they looked forward to moving ahead with the project. Council Member/Commissioner Derry made a motion, seconded by Council Member/Commissioner McGinnis, that said ordinance be laid over for final adoption. COMMUNITY DEVELOPMENT COMMISSION R24. RES. CDC/2006-7 — Resolution of the Community Development Commission of the City of San Bernardino, California, designating check signers and countersigners for the City of San Bernardino Redevelopment/Economic Development Agency checks and wire transfers, and repealing Resolution No. CDC/2005-34. Council Member/Commissioner McGinnis made a motion, seconded by Council Member/Commissioner Estrada, that said resolution be adopted. Public Comments Jay Lindberg, 6340 Orange Knoll, San Bernardino, CA, voiced some of his concerns with the electronic voting system and spoke about the pollution at the former Norton Air Force Base. Councilman Gordon McGinnis introduced his fiancee, Emelinda Figueroa, and announced their plans to get married on May 27, 2006. 13 03/06/2006 NB I. Determination of a local emergency RES. 2006-69 - Resolution of the City of San Bernardino proclaiming existence of a local emergency. (NB1A) ORD. MC-1219 - An Urgency Ordinance of the Mayor and Common Council of the City of San Bernardino, California amending Section 8.82.050 of Chapter 8.82 of the San Bernardino Municipal Code regarding recovery of expenses for extraordinary law enforcement services. (NB1B) City Attorney Penman stated that this item was being brought forward as a result of the events that occurred at the National Orange Show Events Center over the weekend and the civil disturbance that followed. Council Member/Commissioner Derry made a motion, seconded by Council Member/Commissioner Estrada, that the need to take action on this matter arose subsequent to the posting of the agenda. The motion carried by the following vote: Ayes: Council Members/ Commissioners Estrada, Baxter, McGinnis, Derry, Kelley, Johnson. Nays: None. Absent: Council Member/Commissioner McCammack. City Attorney Penman stated that this resolution would enable the City to seek reimbursement for the extra law enforcement needed at the National Orange Show Events Center over the weekend. He stated that this urgency ordinance would amend the current ordinance thereby making it easier to recover costs from those deemed responsible in the future.
