Description) N/A Finance: Council Notes: RfSO, dOO~-J{)J Agenda Item No. J~ l/ J n J{)lo CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Resolution determining the amount of property tax revenues to be exchanged between the City of San Bernardino and the County of San Bernardino relative to the annexation generally located north of Highland Avenue, East of Golden Avenue. (Annexation No. 359) BACKGROUND: On January 6, 2006, authorization to proceed was given for the proposed annexation property generally located north of Highland Avenue, East of Golden Avenue, to be known as Annexation No. 359. Pursuant to Section 99 of the Revenue and Taxation Code, agencies affected by a change of jurisdictional boundaries must negotiate the re-distribution of property taxes for property within the affected area and respond with a resolution. This must be accomplished within 60 days of receiving a response from the Auditor-Controller. In this case, the negotiations consist of the implementation of a formula that was established by the County in 1983. Attached for your consideration is a resolution determining the amount of tax transfer that is to occur between the County and the City upon annexation of this territory. A detail of the amount to be transferred, by tax rate area, is attached as Exhibit "A" to the resolution. The deadline for submitting the resolution to LAFCO is May 2, 2006. Upon annexation, the total property tax to be transferred to the City for the area to be annexed is S76,775.00. This transfer amount is determined using a supplemental formula adopted by the Board of Supervisors. This area is also within a designated Inland Valley Development Agency (IVDA) redevelopment area. The IVDA currently receives tax increment funds for this area and will continue to receive these funds. FINANCIAL IMPACT: Annual property tax revenues in the amount of $76,775.00 will be received after annexation. RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE 3 AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN BERNARDINO AND THE COUNTY OF SAN 4 BERNARDINO RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED 5 BY LAFCO 3049 FOR THE ANNEXATION OF UNINCORPORATED TERRITORY, GENERALLY LOCATED NORTH OF HIGHLAND AVENUE, EAST OF GOLDEN 6 AVENUE, TO BE KNOWN AS ANNEXATION NO. 359. 7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 8 OF SAN BERNARDINO AS FOLLOWS: 9 SECTION 1. Recitals. That the Mayor and Common Council of the City of San 10 Bernardino hereby find and detern1ine that: 11 12 13 A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the issuance of a certificate of filing by the Local Agency Formation Commission Executive Officer, the governing bodies of all local agencies whose service area or service responsibilities will be 14 15 altered by a proposed jurisdictional change shall negotiate and determine by resolution the 16 amount of property tax revenues to be exchanged between and among such local agencies. 17 8. Except as provided in Section 99.1 of the Revenue an Taxation Code, in the 18 event that a jurisdictional change would affect the service area or service responsibility of one or 19 20 21 22 more special districts, the Board of Supervisors of the County of San Bernardino shall, on behalf of the district or districts, negotiate any exchange of property tax revenues. C. The Mayor and Common Council of the City of San Bernardino and the 23 Board of Supervisors of the County of San Bernardino have determined the amount of property 24 tax revenues to be exchanged as a result of jurisdictional change described by LAFCO 3049, for unincorporated territory, generally located north of Highland A venue, east of Golden A venue. SECTION 2. Implementation. A. The negotiated exchange of property tax revenues between the City of San Bemardino and the County of San Bemardino, attached hereto as Exhibit "A" and incorporated herein by reference, resulting from the above described jurisdictional change, is hereby approved and accepted. SECTION 3. The annual tax increment generated in the area subject to the jurisdictional 10 change and attributable to the local agencies whose service area or service responsibilities will be 11 12 13 14 15 16 altered by the proposed jurisdictional change shall be allocated in the future years pursuant to the provisions of Section 99 of the Revenue and Taxation Code. SECTION 4.
