CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subiect: Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the Mayor or his designee, the Director. Parks, Recreation & Community Services Department to execute a Memorandum of Understanding with the San Bernardino City Unified School District to provide contractual services for seventeen (17) before & after-school recreation programs at school district sites. Backeround: The Children's After-School Program for Success (C.A.P.S.) is a grant funded program administered by the San Bernardino City Unified School District to provide before & after- school programs at school sites. The city has been a sub-contractor to the school district in this program since 1999. Each school site provides teachers and aides to teach educational and tutorial programs. The Parks, Recreation and Community Services Department provides arts and crafts, as well as other recreational activities to the youth. The purpose of this Memorandum of Understanding (MOU) is to specify the parameters under which the City of San Bernardino agrees to provide contractual services to the San Bernardino City Unified School District for seventeen (17) before & after-school sites for a period beginning July I, 2006 through June 30, 2007. Last year the District requested a MOU with a description of in-kind services that we would provide to the District. Based on District deadlines this year a Letter of Support was provided (refer to "Attachment B") with the provision that a MOU would be forwarded at a later date, pending Council approval. This MOU and Letter of Support will be included in the District's application for State and Federal CAPS funding. Once the District has been awarded funding, an agreement between the District and City will be drafted that covers the direct cost of the CAPS program at the seventeen (17) school sites identified on Attachment "A". This will require another Council Action and approval from Mayor and Common Council. Financial Impact: The financial impact to the City is $41,600, which will be included in the department FY 06-07 general fund budget recommendations. This total amount includes administrative and program supervision - $37,350, mileage - $500, printing - $1,200, new staff drug testing - $500, new staff TB testing - $250, and new staff fingerprinting - $1,800. In addition, there is a $1,500 gardening grant, and an in-kind volunteer Master Gardner - $300. The total program budget is $43,400. SECTION II: TERM OF AGREEMENT The term of this agreement shall be from July 1, 2006 through June 30, 2007 unless terminated pursuant to Section VIII. SECTION III: PROGRAM SERVICES The CITY agrees to provide the following services: A. The CITY will provide a variety of learning experiences in the area of art, physical fitness, gardening education, sports skills, and values through the provisions of a Recreation Leader at each school designated for the Creative Before and After-School Program for Success (CAPS). A list of participating schools is attached to this MOU as Attachment "A". Page 1 of7 SECTION IV: SECTION V: B. The CITY agrees to provide in-kind services/activities for program administration and site supervision ($37,850.00, refer to Attachment "B"). c. The CITY agrees as in-kind, to conduct background checks and TB tests. Expenses estimated at $3,750.00, based on average 50 per year, incurred to implement this requirement will be the sole responsibility of the CITY. The DISTRICT agrees to provide the following services: A. To compensate the CITY for services rendered in Section IIIA above. The CITY shall invoice the DISTRICT on a monthly basis (invoice by July 31 for the month of June and hereafter) with payment made to the CITY by the DISTRICT one month after receipt of invoice and hereafter. WAIVER OF RESPONSIBILITY The CITY hereby agrees to indemnify, defend, (with Council approval by CITY) and hold harmless the DISTRICT and its departments, agents, officers, and employees from any and all claims or sums which the DISTRICT or any of its departments, agents, officers, or employees may be obligated to pay by reason of any liability of any kind imposed upon them, including damages to property or injury or death of persons, arising out of the performance of the services rendered by the CITY or caused by any error, omission, or act of the CITY or of any person employed by the CITY or of any others for whose acts the CITY is legally liable. Said sums shall include, in the event of legal action, court costs, expenses of litigation, and reasonable attorney's fees. The DISTRICT hereby agrees to indemnify, defend, (with Board approval by DISTRICT) and hold harmless the CITY and its departments, agents, officers, and employees from any and all claims or sums which the CITY or any of its departments, agents, officers, or employees may be obligated to pay by reason of any liability of any kind imposed upon them, including damages to property or injury or death of persons, arising out of the performance of the services rendered by the DISTRICT or caused by any error, omission, or act of the DISTRICT or of any person employed by the DISTRICT or of any others for whose acts the DISTRICT is legally liable. Said sums shall include, in the event of legal action, court costs, expenses of litigation, and reasonable attorney's fees. The costs, salary and expenses of the City Attorney and members of his office in enforcing this Agreement on behalf of the CITY or DISTRICT shall be considered as "attorney's fees" for the purpose of this paragraph. Page 2 of7 SECTION VI: SECTION VII: SECTION VIII: SECTION IX: ADDITIONAL RESPONSIBILITIES Both the DISTRICT and the CITY agree to abide by the following: 1. Both parties agree to protect and maintain confidentiality of all participants. 2. Both parties shall not discriminate against any clients on the basis of race, national origin or ancestry, religion, sex, marital status, age, political affiliation or disability. 3. Provide excellent customer service to all enrolled participants. MODIFICATIONS This MOU may be modified in any form by mutual consent of the CITY and DISTRICT. All modifications must be in writing and signed by each party prior to implementation. Each modification should specify the date said modification shall become effective. TERMINATION This Memorandum of Understanding shall continue in effect for a period of one year subject to termination by either party for any reason upon thirty days written notice to the party; provided, however that should County, State or Federal funding for the CAPS cease or decrease, City may unilaterally terminate this Memorandum of Understanding forthwith upon notification to DISTRICT. CERTIFICATION We, the undersigned, have read and agree to abide by the terms of this Memorandum of Understanding. This department has collaborated with the district since the beginning of the CAPS Program and on numerous other projects that address youth issues. We are committed to youth and their development, and are proud to be a collaborative partner with the district to achieve the objectives of the learning centers program grant. The recreation component that we provide includes skill development, social skills and values, in the area of art, physical fitness, sports, gardening, and nutrition education. As a major collaborative partner with the After-School Program (CAPS), the City of San Bernardino Parks, Recreation and Community Services Department agrees to provide a signed Memorandum of Understanding pending council approval on 3/6/06 for the following services: .
