Dept: Council Office Ilate: February 15,2006 MCC Date: February 21. 2006 Synopsis of Previous Council Action: October 17, 2005 - Mayor and Common Council adopted a resolution supporting the Santa Ana River Trail Concept Plan and committing to partner with the County of San Bernardino and other entities as necessary to secure funding to implement the plan and approved the following motions: , Authorize Development Services to initiate amendments to the General Plan as needed pursuant to the Concept Plan; and , Direct the City Administrator to prepare a Action Plan that specifies each department's responsibilities pursuant to the Concept Plan, and , Establish a Santa Ana River Trail Commission comprised of trail supporters that will advise the Mayor and City Council on implementation opportunities through quarterly updates at regularly scheduled meetings of the Mayor and Common Council. Recommended motions: That said Ordinance be laid over for final adoption. CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Subiect: Ordinance of the City of San Bernardino adding Chapter 2.77 to Title 2 of the San Bernardino Municipal Code relating to the Santa Ana River Trail Commission. Background: In March of last year, Mayor Valles appointed Councilmember Longville to chair the Santa Ana River Trail Blue Ribbon Committee. The committee was charged with creating a concept plan for the City of San Bernardino's portion of the trail. The committee created a long-term recreation and open space plan for the City's segment of the river corridor. In October of2005, Mayor and Council approved a resolution supporting the Santa Ana River Trail Concept Plan. In addition to adopting the resolution supporting the plan, Mayor and Council also approved a motion to establish a Santa Ana River Trail Commission comprised of trail supporters to advise the Mayor and Council regarding the Santa Ana River Trail. This ordinance establishes the commission and outlines the composition of its members and their duties. It also establishes that the commission will provide quarterly updates at regularly scheduled meetings of the Mayor and Common Council in April and October of each year. In addition to eight members nominated by the Mayor and each of the seven council members (subject to approval of the Common Council), the chairperson of the commission shall appoint dedicated representatives that include members from various Santa Ana River Trail stakeholder groups. The structure of the commission with broad and inclusive participation will ensure the maximum opportunity for success. Fiscal Impact: None. San Bernardino Municipal Code Section 2.77 is hereby added to read as follows: ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER 2.77 TO TITLE 2 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE SANTA ANA RIVER TRAIL COMMISSION THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 7 8 Chapter 2.77 9 10 11 SANTA ANA RIVER TRAIL COMMISSION Sections: 2.77.010 Members - Appointment. 2.77.020 Duties. 12 2.77.030 Chairperson - Meetings - Vacancies- Absences. 13 2.77.040 Conflict of interest. 14 2.77.010 Members - Appointment. 15 The Santa Ana River Trail (SART) Commission of the City shall consist of eight (8) members that serve at the pleasure of the Mayor and Common Council. Members shall be appointed on 16 the basis of demonstrated knowledge and experience with the Santa Ana River Trail, recognized 17 dedication to the project, or a deep interest in the City of San Bernardino section of the SART. The Mayor and each of the seven Council Members shall nominate one (I) member that serves 18 during the term of their office. Those appointees shall be subject to the approval ofthe Common Council. 19 20 21 The Mayor shall appoint dedicated representatives that serve at the pleasure of the federal, state and county elected officials representing the SART region. The Mayor shall also appoint dedicated representatives from the Mayor's Office, Economic Development Agency, City Administration, Parks and Recreation, Police, Development, Fire, Animal Control and the Public 22 Services Departments to assist the Commission in the realization of the recommendations in accordance with the SART Concept Plan and to ensure the public health, safety and enjoyment 23 of those persons using the SART in the city's jurisdiction. Those appointees shall not be subject 24 to the approval of the Common Council. 25 The Chairperson shall appoint dedicated representatives that include, but are not limited to, representatives from the following stakeholder groups. Those appointees shall not be subject to 26 the approval of the Common Council: 27 . The Santa Ana River Trail Commission shall: Make recommendations to the Mayor and Common Council regarding the development and promotion of the City of San Bernardino section of the Santa Ana River Trail in accordance with the SART Concept Plan adopted by the Mayor and Common Council October 17, 2005. The Commission's formal recommendations will be heard quarterly at regularly scheduled meetings of the Mayor and Common Councilor as may be necessary to respond to time sensitive opportunities. B. Work with public and private cultural organizations to promote the efficient utilization of community resources. 1 2 3 C. 4 5 D. Accomplish specific projects related to the Santa Ana River Trail Concept Plan. 6 2.30.020 Chairman - Meetings - Absences. The Santa Ana River Trail Commission shall be organized and shall function pursuant to 7 the provisions of Section 2.17.060 and Section 2.17.070 of the San Bernardino Municipal Code. (Ord.
