SUBJECT
Resolution of the City of San Bernardino authorizing the obligation and expenditure of the allocated
FY 06/07 Justice Assistance Grant (JAG) funds and authorizing the signing of an interlocal JAG
grant agreement with the County of San Bernardino.
BACKGROUND
At President Bush's request, Congress consolidated the Byrne Grants and LLEBG into a single
program known as the Edward Byrne Memorial Justice Assistance Grant (JAG) in order to
streamline funding and grant administration. The following new JAG guidelines were implemented
that changed the grant application, funding formulas and grant administration processes.
. JAG funds are split 60-40%, with 60% going to the state of California for the Edward
Byrne J\lemorial grants administered by the Office of Emergency Services. The
remaining 40% go to local law enforcement agencies as grant funds formerly known as
the Local Law Enforcement Block Grant.
. One aggregate grant application for all JAG funds allocated to county law enforcement
agencies must be ftIed with the Bureau of Justice Assistance. The application is due to
the Bureau of Justice Assistance no later than March 2, 2006.
. One jurisdiction in the county must act as the grant administrator and fiscal agent for
JAG funds and may charge an administrative fee for performing these duties.
. The mandatory 10% grant match has been eliminated.
. The public hearing and advisory board requirements have been eliminated.
. An Interlocal Agreement concerning the JAG program must be signed by all
jurisdictions in the County and must accompany the grant application.
The County Law & Justice Group has agreed to serve as the grant administrator and fiscal agent for
JAG program funds and will charge each recipient a 5% administrative fee. The County of San
Bernardino has prepared an Interlocal Agreement between the cities within San Bernardino County
and the County of San Bernardino, identifying the County Law & Justice Group as the grant
administrator and fiscal agent and detailing JAG grant administration and billing procedures. Each
jurisdiction's Chief Executi,'e, City Attorney and City Clerk must sign and submit the agreement to
the County Law and Justice Group no later than February 13,2006.
For FY 06/07, the police department's allocation after deducting the 5% administrative fee is
$162,418. This amount is S83,197 (33.9%) less than last year's JAG allocation. In FY 05/06 the
department funded:
(1) Forensic Specialist III
(3) Dispatcher I/II
Miscellaneous Police Equipment
In FY 06/07 the department will fund 72.6% of the salary and benefits of the Forensic Specialist III
and (3) Dispatch positions.
FINANCIAL IMPACT
The Interim Chief of Police has determined the critical needs of the police department for FY 06/07
that are described in the attached FY 06/07 JAG line item budget and budget narrative. The
department will be using the JAG allocation to partially fund four (4) full-time police civilian
positions. For FY 06/07, personnel costs are projected to be $223,791 with $162,418 (72.6%)
provided with JAG grant funds. The remaining $61,373 will be provided by the City's General
Fund. This cost will be included in the police department's proposed budget for FY 06/07. The
civilian positions are existing and filled.

INTERLOCAL AGREEMENT
BElWEEN THE TOWN OF APPLE VALLEY AND THE CITIES OF BARSTOW, CHINO,
COLTON, FONTANA, HESPERIA, HIGHLAND, MONTCLAIR, ONTARIO,
RANCHO CUCAMONGA, REDLANDS, RIAL TO, SAN BERNARDINO, UPLAND,
VICTORVILLE, AND THE COUNTY OF SAN BERNARDINO, CA
CONCERNING DISTRIBUTION OF THE
2006 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD
This Agreement is made and entered into this day of , 2006, by and
between THE COUNTY OF SAN BERNARDINO, acting by and through its governing body,
the Board of Supervisors (hereinafter referred to as "COUNTY"), and the aforementioned
TOWN (hereinafter referred to as "TOWN") and named CITIES (hereinafter referred to as
"CITIES"), acting by and through their respective governing bodies, the Town Council and City
Councils, all of whom are situated within the County of San Bernardino County, State of
California, as follows:
WHEREAS, each governing body, in performing governmental functions or in paying for
the performance of governmental functions hereunder, shall make that performance or those
payments from current revenues legally available to that party; and
WHEREAS, each governing body finds that the performance of this Agreement is in the
best interests of all parties, that the undertaking will benefit the public, and that the division of
costs fairly compensates the performing party for the services or functions under this
Agreement; and
WHEREAS, the COUNTY agrees to release to TOWN and CITIES their respective
grant allocation from the JAG Award within sixty (60) days upon receipt of funds, less five
percent (5%) for administrative fees, as reflected on Appendix 1 here attached and hereby
incorporated by reference as part of this agreement; and COUNTY agrees to use the five
percent (5%) of JAG award funds received from TOWN and CITIES under this agreement for
administrative fees toward the administration of TOWN's and CITIES' programs during the
entire permissible duration of said programs; and TOWN and CITIES agree to deposit their
JAG award funds into a separate trust account in accordance with JAG guidelines; and TOWN
and CITIES each agree to the five percent (5%) reduction of their respective grant allocation
from the JAG award, as reflected on Appendix 1 for administrative fees toward the
administration of this program; and additionally the TOWN and CITIES each agree that it is
their responsibility to ensure these funds are expended in accordance with JAG guidelines,
and that the interest generated from such funds shall be solely applied and expended in
accordance with these same JAG guidelines; and
WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate
the JAG funds,
NOW THEREFORE, the COUNTY and TOWN and CITIES agree as follows:

Section 1.
COUNTY agrees to release to TOWN and CITIES their respective grant allocation from the
JAG Award within sixty (60) days upon receipt of funds, less five percent (5%) for
administrative fees, as reflected in Appendix 1 here attached and hereby incorporated by
reference as part of this Agreement; and COUNTY agrees to use the five percent (5%) of JAG
award funds received from TOWN and CITIES under this agreement, for administrative fees
toward the administration of the TOWN's and CITIES' programs during the entire permissible
duration of said programs.
Section 2.
TOWN and CITIES agree to deposit their JAG award funds into a separate trust account in
accordance with the JAG guidelines; and TOWN and CITIES agree to the five percent (5%)
reduction of their respective grant allocation from the JAG award, as reflected in Appendix 1
for administrative fees toward the administration of this program; and additionally, TOWN and
CITIES each agree that it is their responsibility to ensure these funds are expended in
accordance with JAG guidelines; and that all interest generated from such funds shall be solely
applied and expended in accordance with these same JAG guidelines.
Section 3.
TOWN and CITIES agree to provide COUNTY with sufficient timely information on request as
necessary for COUNTY to meet JAG requirements for quarterly and annual financial and
performance reports.
Section 4.
Nothing in the performance of this Agreement shall impose any liability for claims or actions
against COUNTY other than what is authorized by law.
Section 5.
Nothing in the performance of this Agreement shall impose any liability for claims or actions
against TOWN and/or CITIES other than what is authorized by law.
Section 6.
Each party to this Agreement will be responsible for its own actions in providing services under
this Agreement and shall not be liable for any civil liability that may arise from the furnishing of
the services by any other party.
Section 7.
The parties to this Agreement do not intend for any third party to obtain a right by virtue of this
Agreement

Section 8.
By entering into this Agreement, the parties do not intend to create any obligations, either
express or implied, other than those set out herein; further, this Agreement shall not create any
rights in any party not a signatory hereto.
WHEREFORE, all parties freely and voluntarily agree to all of the above terms.

Expenditure Plan Narrative
ID Bureau Supervisor
The need for an on-site supervisor (ForensIc Specialist III) was identified in an independent audit of
the Property Room conducted in August 1998. Since FY 99/00 this position has been funded by
LLEBG funds. In FY 03/04 the Forensic Specialist III position funded by the Genera] Fund and
assigned to the ID Bureau was eliminated due to budget cuts. The remaining Forensic Specialist III
now supervises both umts.
We need to maintain the current level of staffing and supen'ision in the Property and Evidence
facility and ID Bureau to provide adequate staffing to collect, process, store, and safeguard property
and evidence in police custody and protect the department and City from liability arising from the
mishandling or loss of these items. i\faintaining this position will pro\'ide additional safeguards to
minimize the City's exposure to liability in this critic a] area of police operations. For FY 06/07, the
salary and benefits of the Forensic Specialist III will be $70,860.
Additional Dispatchers
In 2005, the police dispatch center handled 518,126 telephone calls, including 146,322 calls on 9-1-1
lines. From these calls, a total of 101,460 resulted 111 a police response to calls for sen-ice from the
public. This workload makes the dispatch center one of the busiest centers sen'icing medium sized
cities. Since FY 99/00, LLEBG GAG) funding has been used to augment their staff1l1g, providing
funding for three addltiona] dispatcher positions. In January 2005, the police department
implemented Spilt Frequenry DiJpatching, utilizing two primary dispatch channels during peak periods
for calls for service. These positions are essential to maintain quality sen'ice for the public and
department personnel and handle 9-1-1 calls and other calls for police sen.ice. For FY 06/07, the
salary and benefits of the three grant funded Dispatcher Irs will be $152,931.
