'J.f)()6 - 31 :J.J(,)D~ Agenda Item No. ~D CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: Resolution of the Mayor and Common Council of San Bernardino ratifying submittal of the Application for Waste Tire Enforcement Grant Funds from the California Integrated Waste Management Board. BACKGROUND: The California Integrated Waste Management Board receives an annual appropriation from the California Tire Recycling Management Fund to administer the Tire Recycling Act and related legislation. In turn, the Board has allocated funds for the Waste Tire Enforcement Grant Program. For the past ten years, the City has received grant funding to monitor businesses generating waste tires within the City. Funds allocated by the Board for the Waste Tire Enforcement Grant are for inspection, compliance and survey activities of waste tire facilities, haulers, tire dealers, and auto dismantlers. The intent of this activity is to develop and implement an effective inspection and compliance program at the local level that will provide guidance to facility operators, and if necessary, take initial enforcement action necessary to remediate threats to public health, safety, and the environment. These activities enhance the City's current tire enforcement program and compliment enforcement actions by the State. During the current grant period, the City's Environmental Projects staff successfully completed a total of 74 inspections of local tire dealers. Of these inspections, it was determined that only two sites had minor violations. Currently, the City is in the final phase of completing enforcement and survey activities for the 2005/06 Waste Tire Enforcement Grant. The City has noticed a substantial increase in the business owner's awareness of State laws and manifesting requirements as a result of the program and a substantial decrease in the number of illegally stockpiled tires. Grant funds will be used by the City to continue local monitoring, enforcement and education efforts for a seventh grant period. This will permit the City to continue the current education and monitoring of waste tire generators and haulers. The grant application deadline is February 3, 2006. The grant term is June 30, 2006 through June 30, 2007. FINANCIAL IMPACT: The total amount requested in grant funding is $20,485. There are no matching funds required by the City. Of this total request, $16,150 will be utilized to offset personnel costs within the Environmental Projects Division. The remaining $4,335 will be utilized for printing and distribution of educational materials, purchase of equipment used for inspections, costs related to required training conferences, and administrative costs. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO RATIFYING SUBMITTAL OF THE APPLICATION FOR WASTE TIRE ENFORCEMENT GRANT FUNDS FROM THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD. WHEREAS, funds allocated are available from the California Integrated Waste Management Board for grants to solid waste Local Enforcement Agencies (LEA) and cities and counties with regulatory authority within the city and county government to perform waste tire enforcement surveys and compliance activities at waste tire facilities; and WHEREAS, the City proposes to implement a Waste Tire Enforcement Program that involves inspection and compliance activities of waste tire facilities, haulers, tire dealers, and auto dismantlers that will reduce illegal stockpiling and disposal of waste tires. The City has demonstrated it has sufficient staff resources, technical expertise, and experience with similar projects to carry out the proposed program; NOW, THEREFORE, BE IT RESOLVED THAT THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Ratifies the submittal of an application to the California Integrated Waste Management Board for a Waste Tire Enforcement Grant (attached hereto as Exhibit "AU). The Mayor of San Bernardino, or her designee, is hereby authorized to execute in the name of the City of San Bernardino all necessary contracts, agreements, and amendments for the purposes of securing grant funds and to implement and carry out the purposes specified in the application. SECTION 2.
