BACKGROUND: In January of this year, Government Code Section 56375 was approved to allow cities to initiate island annexation proceedings through the Local Agency Formation Commission (LAFCO) for areas that do not exceed 150 acres. This process waives the requirement for protest proceedings and voter approval through January 1,2007. The area to be annexed under this legislation must be surrounded or substantially surrounded by the city to which the annexation is proposed. Under this code, "substantially surrounded" is not defined. However the legislation does state that cities cannot take a smaller part of a larger island. The County LAFCO Commission voted to define "substantially surrounded" as having a minimum of 52% of its linear boundaries surrounded by the city proposing the annexation. Not all LAFCO commissions adopted the 52% definition. LAFCO identified thirteen (13) unincorporated areas in the City of San Bernardino that they feel meet the criteria under this new legislation. However, only one area, located in the 7th Ward, generally between Golden and Del Rosa Avenues, just above Highland, is 100% surrounded. Although LAFCO has adopted the 52% definition of substantially surrounded, because the legislation states that cities cannot take a smaller part of a larger island, staff has made the recommendation to consider the proposed annexation of the only island that is 100% surrounded and meets the criteria of not exceeding 150 acres. This island, as shown on the attached map, is approximately 100 acres and primarily consists of residential use with a mix of single-family and multi-family housing. There is also minimal commercial/retail. The Police Department and the Public Services Department were asked to conduct some preliminary research of this area. The Police Department determined this area to be one that involves significant calls for service. A considerable number of code violations are also present in the area. Because it is not under the jurisdiction of the City, yet completely surrounded by city boundaries, there is little the City can do to deter crime and improve the area. Both the City Attorney's Office and the Police Department concur that annexing this area into the City would allow for necessary enforcement within this area. According to Public Services, the infrastructure (streets, sidewalks, curbs and gutters, and landscape) appears to be in relatively adequate condition. Pursuant to Proposition 218, Utility User Tax could not be imposed in the case of this type of annexation because the annexation will not be "voted in" by residents. According to LAFCO, the City could assume some of the fees collected by the County, such as CSA 38L, which is the paramedic fee. CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Cont. On July 19,2005, this item was brought before the Legislative Review Committee. Upon review of all reports and discussion with staff, the Committee made the recommendation to pursue the annexation of this island and submit this item to the Mayor and Common Council for authorization to proceed with the annexation. If authorization to proceed is given, staff will prepare the documents and necessary applications for submittal to LAFCO. These documents will be brought before Council for approval at a future meeting. FINANCIAL IMPACT: Staff recommends that filing and processing fees in the amount of $4600 will be paid from 001- 190-5502 FY 2005 Carry-over funds (Professional Contractual Services). RECOMMENDATION: That the Director of Development Services be authorized to initiate proceedings for the annexation of an island of unincorporated territory generally located north of Highland Avenue, east of Golden Avenue and that funds be appropriated to pay processing and filing fees in the amount of $4,600.
