Synopsis of Previous Council Action:
July 19, 2004: Mayor and Common Council approved Resolution No. 2004-235 to execute a
Services Agreement between the City of San Bernardino and New Hope Missionary Baptist
Church to provide community services at the New Hope Family Life Center.

Subject:
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
Mayor or her designee to execute Amendment No. I to the Services Agreement between the City
of San Bernardino and New Hope Baptist Church to provide community services at the New
Hope Family Life Center.
Background:
In FY 2004/2005, Council approved Resolution No. 2004-235 with the New Hope Missionary
Baptist Church to provide community services at the New Hope Family Life Center. The New
Hope Missionary Baptist Church has requested a one-year extension to the original Services
Agreement.
New Hope Missionary Baptist Church has significant community service experience that contributed
to a successful first year of the original agreement. Services provided include: rental and utility
assistance, ~ short term housing assistance, clothing closet, job referrals, tax preparation assistance,
tutorial programs, senior nutrition programs, food referrals, Social Security assistance, and arts and
leisure classes. New Hope Missionary Baptist Church will continue to provide these services if
Amendment No. I is approved..
The New Hope Missionary Baptist Church currently has two full-time employees, one part-time
employee, and several volunteers assisting to ensure that all programs and services continue.
However, due to rising cost in providing these services, New Hope Missionary Baptist Church has
requested an increase to their contract of$300 per month.
This amendment would increase the term of payment by $3,600 annually for a total of $75,600 for
the one-year agreement that includes an additional one-year extension. Approval of this agreement
extension will allow these valuable services to continue.
Financial Impact:
The budget for this program has been incorporated in the approved general fund budget for
FY05/06.
Recommendation:

AMENDMENT NO.1
TO THE
SERVICES AGREEMENT
This Amendment No. 1 to the Services Agreement is entered into this day of
, 2005, by and between the CITY OF SAN BERNARDINO and NEW
HOPE MISSIONARY BAPTIST CHURCH relating to the operation of the Wests ide
Community Services Center, located at 1505 West Highland, San Bernardino, Ca. 92411.
I. The Section entitled "I. (A) SCOPE OF SERVICES" is hereby amended to now
read as follows:
"Operate the community services center from Monday through Friday 8 a.m. to 5
p.m. exclusive of the following holidays: September 5, November 11, November
24 & 25, December 23 & 26, December 30, January 2, 2006, January 16, 2006,
February 20,2006, May 29,2006, and July 4,2006."

The Section entitled "2. COMPENSATION AND EXPENSES" IS hereby
amended to now read as follows:
"For all of the above services provided, City agrees to pay CONSULTANT
compensation for a one-year period in the amount of $75,600. The fee shall be
paid in installments of $6,300 with the final payment being $6,300 by the loth of
each month. The fee for services will cover all basic expenses incurred by the
CONSULTANT on behalf of the CITY. CITY shall reimburse no other
expenditures made by CONTRACTOR without the prior written approval of the
CITY."
3. The Section entitled "4. TERM; SEVERABILITY." is hereby amended to now
read as follows:
"The term of this Agreement shall be effective from August 1,2005, through July
31, 2006 with the option of one (l) I-year extension upon mutual consent of the
CITY and CONSULTANT. This Agreement may be terminated at any time by
thirty - (30) days written notice performed by either party. The terms of this
Agreement shall remain in force unless mutually amended in writing."

All other terms and conditions of said Services Agreement is unchanged and shall
remain in full force and effect.

At the Mayor and Common Council meeting of July 18, 2005, the City of San Bernardino
adopted Resolution No. 2005-250- Resolution authorizing the Mayor or her designee to execute
Amendment No. 1 to the services agreement between the City of San Bernardino and New Hope
Baptist Church to provide community services at the New Hope Family Life Center.
Attached is one (1) original agreement and two (2) duplicate original agreements. Please obtain
signatures in the appropriate locations and return the ORIGINAL contract marked appropriately,
to the City Clerk's Office as soon as possible, to my attention. Please keep the remaining two (2)
fully executed copies for your records and for the other party.
Please be advised that the resolution and contract will be nuD and void if not executed
within sixty (60) days from the date of adoption, or returned to our office by November 18,
2005.
