STAFF REPORT
Subject:
Resolution approving Amendment No.1 to Agreement for Services with Transtech Engineers,
Inc. for professional civil engineering plan checking services.
Background:
The Development Services Department is responsible for plan checking for various land
development projects. This program consists of the review and plan checking of roads,
bridges, buildings, grading, drainage, landscaping, traffic signals, on-site improvements,
handicap ramps, etc.
Contract plan checking is essential to providing a continually improving level of service to the
development community. Land development in the City of San Bernardino has increased
significantly over the last five years and having the services of one or more consultant firms is
essential for providing timely plan checking during peak periods as we are currently
experiencing.
Provisions for expedited plan checking were established in 1986 by Resolution No. 86-350.
Under terms of the resolution, a developer requesting expedited plan check is required to post
a deposit of 150% of the total City estimate of the fees, based on the standard plan checking
rates. Upon completion of the plan check, a final accounting is prepared and 20% is added to
the actual amount of the consultant's bills to cover City staff costs. Prior to plan approval, the
developer is required to pay any; costs not covered by the initial deposit. Any surplus above
the amount of the consultant's fees plus 20% is refunded to the developer.
On August 2, 2004, the Mayor and Common Council adopted Resolution No. 2004-245
approving an Agreement for Services with Transtech Engineers, Inc. and Willdan to provide
expedited engineering plan check services. The selection of Transtech Engineers, Inc. and
Willdan to perform this work was based on competitive proposals received from four
consulting engineers.
Transtech Engineers, Inc. executed and returned their Agreement and has been performing
Public Works plan checking services for the City for the past year. Willdan had issues with
the City's standard liability language in the Agreement for Services and declined to execute it.
Willdan did not execute and return the Agreement within the mandatory 60 days as required by
Section 2 of the Resolution, therefore, the City's approval of Willdan's Agreement was
automatically rescinded.
Section C4 of the Agreement establishes the term of the Agreement with Transtech Engineers,
Inc. as one year. Transtech Engineers, Inc. has performed their duties providing expedited
plan checking services in a timely and accurate manner. Therefore, staff is requesting that the
Agreement with Transtech Engineers, Inc. be amended to provide for an extension of one
additional year beginning August 2, 2005.

Transtech Engineers, Inc. has agreed to the extension of time, but is requesting a 3 % increase
in their established hourly rate in accordance with the latest local Consumer Price Index (CPI).
That will increase the established rate from $75.00 per hour to $77.25 per hour. The
consultant is also requesting that it be compensated separately for direct expenses, such as
scanning, printing, delivery, etc. Staff feels the requested changes in compensation are
reasonable and consistent with standard industry practices.
Financial Impact:
Under the provisions of Resolution No. 86-350, all costs associated with expedited plan
checking services are paid by the developer, including City staff time. Therefore, there is no
cost to the City for expedited plan checking.
Recommendation:
Adopt Resolution.

RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING
AMENDMENT NO.1 TO AGREEMENT FOR SERVICES WITH TRANSTECH
ENGINEERS, INC. FOR ENGINEERING PLAN CHECKING SERVICES.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION I. Transtech Engineers, Inc., a firm that is competent, experienced, and able to
perform requested services, has been adequately providing Consultant Engineering Plan
Checking Services to the City for the past year. Pursuant to this determination, the Purchasing
Manager is hereby authorized and directed to issue a Purchase Order for said services to said
firm up to the amount of $350,000; but such authorization shall only be effective upon the
issuance of a Purchase Order by the Purchasing Manager. The Mayor is hereby authorized and
directed to execute an Amendment to Agreement for Services on behalf of the City; a copy of the
Amendment No. I to Agreement for Services is attached hereto and incorporated herein (Exhibit
SECTION 2. The authorization to execute the above referenced Amendment No. I to
Agreement for Services is rescinded ifit is not signed by the parties within sixty (60) days of the
passage of this resolution.

EXHIBIT A
AMENDMENT NO.1 TO AGREEMENT FOR SERVICES
This AGREEMENT is made and entered into this
by and between Transtech Engineers, Inc. ("Contractor")
BERNARDINO ("CITY").
WITNESSETH:

A. WHEREAS, on August 2, 2004, the Mayor and Common Council of CITY
adopted Resolution No. 2004-245 approving an Agreement for Services with
CONTRACTOR for Engineering Plan Checking Services, and
B. WHEREAS, CONTRACTOR, under terms of said Agreement for Services, has
performed competent and timely plan checking services for CITY since August 2,
2004,and
C. WHEREAS, said Agreement for Services will expire on August 2, 2005, and
D. NOW, THEREFORE, the parties hereto agree as follows:
1.
Section C2 of the Agreement for Services is hereby amended to read as
follows: "Over the term of this Amendment No. 1 to Agreement for
Services, CONTRACTOR shall be paid for such services an amount not
to exceed $350,000, in accordance with Attachment A (attached to the
previous Agreement, dated August 2, 2004). This Agreement may be
canceled by two weeks written notice by either party".
2. Section C4 of the Agreement for Services is hereby amended as follows:
"The term of this Amendment No. 1 to Agreement for Services shall begin
August 2, 2005, but shall not exceed one year."
3. Compensation for the work over the term of Amendment No. 1 to
Agreement for Services is hereby established as $77.25 per hour for all of
CONTRACTOR'S professional and technical staff involved in the plan
checking process. This hourly rate shall supersede the hourly rate
previously set by Attachment A. The billing will be for actual time spent
on the plan checks at the established hourly rate plus all direct expenses,
such as scanning, printing, delivery, etc.
4. All other terms and conditions of the Agreement for Services shall remain
in full force and effect.

adopted Resolution No. 2005-240 - Resolution approving Amendment No. 1 to Agreement for
Services with Transtech Engineers, Inc. Professional Civil Engineering Plan Checking Services.
Attached is one (1) original agreement with two (2) duplicate original agreements. Please obtain
signatures in the appropriate locations and return the ORIGINAL agreement to the City Clerk's
Office as soon as possible, to my attention. Please forward one (1) fully executed copy to
Transtech Engineers, Inc. and retain one (1) for your records.
Please be advised that the resolution and contract will be null and void if not executed
