PENMAN City Attorney Subject: Waiver of potential conflict of interest of Law Firm of Best, Best & Krieger Dept: CITY A TIORNEY Date: July 1, 2005 Synopsis of Previous Council Action: On May 2, 2005, the San Bernardino City Council approved the hire of the law firm of Best, Best & Krieger to represent the City in the matter of the Disability Retirement Appeal to the State Office of Administrative Hearings by Ex-Police Officer Ronald Van Rossum. Recommended motion: That the potential conflict of the law firm of Best, Best & Krieger, arising from that firm's past and current representation of the City and the request of the City of Loma Linda to hire said firm regarding an adverse position the City of Loma Linda has taken on a wastewater issue with the City of San Bernardino Municipal Water Department, be waived. ~ -;I. f~ i nature Contact person: James F. Penman, City Attorney DATE: July 1, 2005 AGENDA ITEM No. 52: Waiver of Conflict of Interest The City of Lorna Linda is planning to build their own small, wastewater stripper plant which will strip off secondary wastewater but will continue to transmit whatever isn't treated at their plant to the wastewater plant in the City of San Bernardino. The City of Lorna Linda contends there should be a reduction in the fee they pay San Bernardino for our wastewater treatment plant to process their wastewater when their plant becomes operational. They also contend they are entitled to a rebate of certain past fees. However, our plant will still need to reserve capacity for the bio-solids, for the remaining wastewater stream, and for those times when Lorna Linda has no demands for the recycled water they expect their proposed plant to produce. (Lorna Linda's proposed plant will have no ability to digest bio-solids, which will still have to be treated at our wastewater treatment plant.) The law firm of Best, Best & Krieger has represented the City on various matters in the past. That firm is presently representing the City of San Bernardino on only two cases, a police personnel issue and a Fire Department Union proposal. It is unlikely that the firm's past or current representation of our City would raise any actual conflicts if the firm is retained by the City of Lorna Linda to represent that City in the above-described controversy.
