STAFF REPORT
SUBJECT
Resolution of the City of San Bernardino authorizing the Chief of the San Bernardino Police
Department to execute a Memorandum of Understanding with the California State Police of San
Bernardino.
BACKGROUND
The City of San Bernardino Police Department and the California State University Police of San
Bernardino have participated in a mutual aid Memorandum of Understanding for a number of
years. Currently, the Police Department investigates certain felony crimes on the University
campus while the majority of police calls are handled by the University police. This is to update
the original MOU as both police agencies now have new police chiefs.
FINANCIAL IMPACT
There is no financial impact incurred by either agency.
RECOMMENDATION
Adopt resolution.

OF THE SAN BERNARDINO POLICE DEPARTMENT TO EXECUTE A
'MEMORANDUM OF UNDERSTANDING WITH THE CALIFORNIA STATE
UNIVERSITY POLICE OF SAN BERNARDINO.
SECTION 1: The City of San Bernardino Police Department and The California State
University Police of San Bernardino have agreed that the San Bernardino Police Department
will investigate certain felony crimes occurring on the university campus. This Memorandum
of Understanding is to update the current MOU between the two agencies.
SECTION 2: Pursuant to this determination, the Mayor or her designee the Chief of
the San Bernardino Police Department is hereby authorized and directed to execute a
Memorandum of Understanding with the California State University Police of San Bernardino
r~newing the terms and conditions of the new agreement.
SECTION 3: The authorization to execute the above referenced Memorandum of
Understanding is rescinded if it is not issued within sixty (60) days of the passage of this
resolution.

Memorandum of Understanding Between The
San Bernardino Police Department and The
California State University Police, San Bernardino
o
1. The San Bernardino Police department agrees to investigate incidents of homicide and
recent rape that occur on the property and campus of the University within the city limits
of the City of San Bernardino. The University Police shall inveStigate and be responsible
for all robbery and aggravated assault cases occurring on University property. The San
Bernardino Police Department will also provide the crime scene processing and physical
evidence collection at all homicide and rape crime scenes they handle on campus. When
University Police personnel respond to such a case, they will immediately secure the
scene and protect it from contamination. When the San Bernardino Police personnel
arrive, they will assume primary responsibility. The University Police will at that time
assume a support role as directed by the ranking San Bernardino Police officer on site. In
general this supporting role shall include, but is not limited to, scene containment and
protection as well as traffic control. Except as noted the University Police will investigate
and collect evidence on all other crimes occurring on University property.
For clarification purposes, Part I Violent Offenses will be managed in the following

2. The California State University Police Department's primary law enforcement
responsibility is the University campus. However, the University Police Department's
jurisdiction extends one mile from the aforementioned campus into the San Bernardino
community. The geographical boundaries can be described as follows: North of the

campus includes the power plant, Devils Canyon and Badger Canyon. South of the
campus includes the 215 Freeway and South of 40th Street of campus includes Pine
Avenue. East of the campus includes Mountain Dr., 3rd Avenue., Leulinger Dr. and N. H.
St. (Note attached map).
The San Bernardino Police Department is the primary law enforcement agency in the
City of San Bernardino. Their jurisdiction extends throughout the City of San Bernardino
up to the CSUSB campus.
3. In the event of an "Active Shooter" situation on campus the University Police
Department will respond. The University Police Department will notifY the San
Bernardino Police Department. An officer of the University Police will generally serve as
the Incident Commander unless the situation would indicate other options. Executives,
managers and supervisors from SBPD or other agencies will be needed at the command
post for tactical support, strategy and counsel.
4. The San Bernardino Police Department will respond to any hostage andlor sniper
situations that occur on University property within the city limits of City of San
Bernardino. The University Police will notifY the San Bernardino Police Department
immediately upon learning of such an incident and take any actions needed to prevent
jeopardy or injury to innocent persons. Upon arrival, the San Bernardino Police
Department shall assume primary responsibility of operational command and execution.
University Police personnel shall provide any assistance deemed appropriate by the San
Bernardino Police officer assigned as incident commander.
5. San Bernardino Police personnel will be available to respond to a riot or imminent riotous
conditions on the University campus. In the event a request for such assistance is granted,
all San Bernardino Police personnel who respond shall be under the operational control
of a lead officer designated by the San Bernardino Police Department. All assignments,
orders, and directions or other instructions directed to San Bernardino Police officers may
come only from the city's designated lead officer.
If the university expects an event to develop into situation requiring assistance for
personnel of the San Bernardino Police Department, that department shall be notified of
such circumstances at the earliest possible time. The San Bernardino Police Department
shall be included in any planning and contingency considerations associated with the
event. Further, if a commitment of San Bernardino Police resources for a planned event
will be required, compensation of those resources will be discussed, identified, and
agreed upon by both the San Bernardino Police Department and the University prior to
actual commitment of city resources.
6. At the request of San Bernardino Police Department, the University Police will continue
to provide mutual assistance to the San Bernardino Police in the canyon area adjacent to
the campus.

7. The University Police will respond, if available, to traffic accident scenes adjacent to the
campus and render assistance to accident victims until the arrival of San Bernardino
Police Department units. The University Police will notifY the San Bernardino Police of
traffic accidents immediately.
8. University Police will respond to any "999" situation reported by local law enforcement.
9. When San Bernardino Police personnel are expected to be unavailable for an extended
time, University Police may be requested by the city to respond to a reported crime
occurring in proximity to the campus not exceeding one mile. Such a response shall
generally be limited to preserving the public peace, performing an initial investigation
and taking a preliminary report. Requests for assistance shall be at the discretion of a
designated supervising officer of the San Bernardino Police Department, and transmitted
through the University Police Dispatch center to the University Police Watch
Commander. University Police will be used for this purpose only when San Bernardino
Police resources are depleted and relief is not expected for an exceptionally lengthy
period of time.
10. University Police are not expected to volunteer their assistance to the San Bernardino
Police Department aside from what is identified herein.
11. When mutually agreed upon and resources permit, California State University police
officers and San Bernardino police officers may arrange to cross train in their respective
jurisdictions and share intelligence information. These sessions may include, but are not
limited to; ride-a-Iongs for familiarization of procedures and beat information, team
meetings to exchange information on concurrent crime problems, and training sessions of
mutual benefit as arranged by either department and mutually agreed upon. The purpose
of such activities will be to enhance mutual officer safety and teamwork between the two
departments.
12. Each party to this agreement shall provide, at it's sole expense, the Worker's
Compensation Insurance coverage necessary for it's own employees. At no time shall the
employees of one party be considered to be employees of the other. Each party agrees to
defend, indemnifY and hold harmless the other party from all loss, liability, or claim
because of or arising out of any acts or omissions of the indemnifying party, it's officers,
employees or agents in it's performance under the terms of this agreement.
13. This agreement shall remain in effect until terminated by either party giving written
notification ofintent at least thirty (30) days in advance of the intended date of
termination.
14. This agreement shall supersede any prior agreements on this subject, including the MOU
of October 19, 1998.
