Each redevelopment agency, on or before May 10,2005, must remit to the county auditor its ERAF amount as determined by the State Director of Finance. If any agency fails to transmit the full amount of funds required, if it is precluded by court order from transmitting the amount, or it is otherwise unable to meet its full obligation, the county auditor, no later than May 15,2005, shall transfer any amount necessary to meet the obligation from the loca1legislative body's property tax allocation, including the City's allocation. The Economic Development Agency's ("Agency") ERAF obligation for the fiscal year 2004-05 is $1,828,023. In order to meets its obligation, the Agency will borrow from the Low-and Moderate Income Housing Fund as allowed by State legislation as previously authorized by the Community Development Commission ("Commission") on December 20, 2004. CURRENT ISSUE: Senate Bill 1045, approved on September 1, 2003, amended California Health and Safety Code Section 33333.6 to provide that the legislative body (in this case, the Mayor and Common Council) may enact an ordinance to extend by one year the time limit on the effectiveness of a redevelopment plan adopted prior to January 1, 1994, and the time limit for payment of indebtedness and the receipt of property taxes (tax increment), when the Agency is required to make an ERAF payment for that redevelopment project area. The following chart illustrates the current and proposed time limits on the effectiveness of the redevelopment plans adopted prior to January 1, 1994, along with the current and proposed time limits for payment of indebtedness and the receipt of tax increment. Senate Bill 1045 further allows that such ordinances may be adopted without normal compliance procedures for redevelopment plan amendments. These plan amendments will allow the Agency an additional year to recoup its ERAF obligation. ENVIRONMENTAL IMPACT: None.
