City is involved in negotiations with the School District Joint Facility Use Agreement
involving the Cesar Chavez Middle School. The City and District were going to have joint use of
gymnasium facility. Negotiations going on; our office not involved. Councilman Kelley and Fred
Wilson requested our office to get involved. Assigned Marianne Milligan to be attorney to advise
City's negotiation team and participate in negotiations. Then, because wife on School Board, asked
Council to waive the conflict. First voted to consider matter as a matter where the need to take
action arose after agenda was posted. Motion was made and passed unanimously.
Motion made-waived conflict of City Attorney because City Attorney's wife is
on School Board. Passed unanimously.
Advised Council when actual agreement is finished, will have independent counsel advise
the City Council on fmal agreement because City Council votes on it.
Two Motions:
Voted to consider matter as a matter where the need to take action arose after
agenda was posted. Passed unanim6usly.
Waived conflict of City Attorney because City Attorney's wife is on School
Board. Passed unanimously.
