The last comprehensive user fee update was approved by the Mayor and Council in August 2004. In light of the City's budget situation, all departments were asked to again evaluate their user fee schedules and provide information concerning potential fee updates. The various proposals have since been discussed with the working group of Councilmembers that has been working with the Mayor and staff to address the FY 2005-06 budget situation. As you may recall, user fees cannot exceed the cost of providing the given service. Departments have completed the costs analysis worksheets with information regarding each service for which a fee is charged, including the classifications of any employees involved, the amount of staff time involved in providing the service, and other related costs for materials, supplies, equipment, utilities, etc. Information regarding hourly salary and benefit rates was also included in the worksheets. Formulas have then been used to calculate the department overhead rate. The citywide administrative rate for each department has been applied to the subtotal of costs for each fee. This process results in the determination of the total service cost per unit. Each department's recommended fees are based on this service cost per unit. Staff has also gathered information concerning comparable fees in neighboring jurisdictions, and that information has been included on the worksheets. The resolution includes the following new or revised fees. The summary matrix on Attachment A identifies the current and proposed amounts for each of these fees: Animal Control Division Euthanasia request fee Animal pick-up service charge Police Department Impounded vehicle release fees Photograph fees Dispatch tape reproduction fees Parks, Recreation, and Community Services Department Community center room rental fees Miscellaneous Fireworks regulatory fee ~'"' ""'"'-'", ""'""ii'i,'''C'"0~r'''' '" "mf ".i""=~, "q'n'IT""'~~_'" iT'"''''''''I,'''-';-i~~,~#,~,q"..- =~~'~ ~, ". r T1~-r""~Fi"":;::::::",:,::" During the public hearing, the Mayor and Council will consider a master fee resolution that incorporates all these revised fees along with other fees that remain unchanged. At the conclusion of the public hearing, and the Mayor and Council may adopt the various fees. The Mayor and Council should also be aware that a study of the City's planning, building, and engineering user fees is also in the early stages, along with a separate study of development impact fees. It is anticipated that the study will be completed in the summer. Once the study is completed, any recommended revisions to those fees will be brought back to the Mayor and Council at a later date. In addition, the Development Services Department is bringing forward an ordinance that will update the building construction valuation tables that are used to calculate certain building permit and plan check fees. Financial Impact: If the proposed fee adjustments are approved, potential revenue increases will be associated with each fee change. The detail concerning these additional revenues can be found on Attachment A. The total additional revenue to all funds is estimated to be $212,100. Of this total amount, the fireworks regulatory fee is anticipated to generate approximately $110,000 in revenue to the General Fund which will be used to offset new expenses related to additional enforcement and public education. A RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING CERTAIN FEES FOR SERVICES FURNISHED BY THE CITY OF SAN BERNARDINO, AND REPEALING RESOLUTION NO. 252 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: Part I: Master fee resolution revisions. SECTION I. This master fee resolution revises certain Parks, Recreation, and Community Services Department, Animal Control Division, and Police Department fees. This master fee resolution also establishes a fireworks regulatory fee in accordance with Section 8.60.095 of the San Bernardino Municipal Code. No other fees established in the previous master fee resolution, Resolution No. 2004-252, are being modified by this resolution. Part II: Repeal of previous master fee resolution and amendments. SECTION l. Resolution No. 2004-252 is hereby repealed. Part III: Animal Control SECTION l. The license fee for each dog not spayed or neutered shall be $60;00 annually. SECTION 2. The license fee for each spayed or neutered dog shall be as follows: A. $15.00 for a one year period. B. $25.00 for a two year period. C. $35.00 for a three year period. SECTION 3. A fee of $3.00 shall be charged for the transfer of ownership of a licensed dog to a new owner in lieu of a fee for a new license for the remainder of the licensing year in which the transfer occurs. D. A fee of$3.00 shall be charged for the transfer of a current license from another jurisdiction for the remainder of the licensing year. E. The fee for any license purchased under Part II of this resolution may be prorated so as to expire during the same month as the month the rabies vaccination was issued. SECTION 6. In order to recover anticipated expenditures for maintenance, feeding and care of apprehended livestock, the following fee schedule is established: A. In the event of cancellation by the Department, notice will be given as far in advance of the scheduled use as is possible under the circumstances. 9 SECTION 5. Definitions. The fees may be collected by any lawful means available to the City of San Bernardino. None of the proposed increases exceed the actual costs of providing such services and facilities, and, for those costs not completely paid for by the proposed fees, the additional expense to the City of providing services and facilities shall be borne by the general fund of the City of San Bernardino. C. The proposed fees and charges are reasonable and necessary to enable the City of San Bernardino to more nearly meet the actual costs of providing such services and facilities. SECTION 2. Policy. Public facilities, including public parks, recreation buildings and swimming pools and certain equipment, under the jurisdiction of the Parks, Recreation and Community Services Department, are public property and as such are available for use by any person or persons in accordance with the following specifications and as deemed appropriate by the Director. SECTION 3. Procedure. The facilities and equipment shall be used only for those meetings and activities pursuant to City Municipal Code Chapter 12.80. For the purposes of determining the appropriate fees to be charged for services rendered by the Parks, Recreation, and Community Services Department, the following definitions shall apply: A. "Special Event" shall be any event held at a City park facility which is open to the general public and is hosted by a non-profit or private organization. This assumes a minimum of 200 or more individuals in attendance for purpose of the damage bond/clean-up deposit. B. (For providing a waiver of the Alcohol Prohibition Ordinance at City Parks, Recreation and Community Services Facilities): 1. Special Events, Athletic Events, Fundraisers. Sponsor must be an established non-profit organization. Beverages are restricted to beer and wine. Alcohol Permit Fee: $50.00 - when ABC Permit is not required and participation is 150 or less. $100.00 - when ABC Permit is required or participation exceeds 150. Groups in this classification shall pay no fee for use of outdoor athletic facilities. SECTION 12. Waivers & ExemDtions. A. The Mayor or his designee may exempt non-profit associations and corporations organized primarily for patriotic, civic betterment or charitable purpose or any local civic or charitable organization from the foregoing rates and fee schedule for the use of park and recreation buildings and facilities upon a finding that the fee would create a financial hardship jeopardizing the activity or event planned for such use and that the activity or event will be of unusual benefit to the residents of the City and should be supported with public funds. The work 'local' as used herein is defined to mean an organization whose membership is comprised of fifty-one percent (51 %) of city residents. B. As a condition of exemption, the association, corporation, organization or group seeking exemption may be required to perform services or provide labor beneficial to the City of its residents.
