Staff Report
Subject:
Resolution awarding a contract to Powell Engineering Construction for Drainage Improvements and
Pavement Rehabilitation on Bailey Court (SD04-14) per project Plan No. 11248.
Background:
On September 7, 2004, the Mayor and Common Council allocated $150,000.00 in the Storm Drain
Construction Fund for Drainage Improvement and Pavement Rehabilitation on Bailey Court (SD04-
14), as part of the FY 2004/5 Capital Improvement Program (CIP).
This project consists of the following:
1. Grinding of the existing street asphalt pavement on Bailey Court.
2. Construction of new storm drain on Bailey Court at curve.
3. Installation of asphalt pavement overlay on Bailey Court.
4. Repair of damaged asphalt disturbed by contractor's operations.
The plans and specifications for this project are complete. The project was advertised locally in the
San Bernardino County Sun Newspaper, F. W. Dodge, Construction Data Hot Sheet, Reed
Construction Data and Bid America, Construction Bidboard, Inc, the City's web sites, and with the San
Bernardino Area Chamber of Commerce.
Bids have been received and are listed below:

Based on review of the sealed competitive bids received, staffhas determined that Powell Engineering
Construction of Orange, the apparent low bidder, has met the minimum requirements of the
specifications and bid guidelines. Therefore, staff recommends that the Mayor and Common Council
award the referenced contract to Powell Engineering Construction.

CONSTRUCTION FOR DRAINAGE IMPROVEMENT AND PA VEMENT
REHABILITATION ON BAILEY COURT (SD04-14), PER PLAN NO. 11248.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Powell Engineering Construction, 974 N. Morgan, Orange, CA 92867, IS
the lowest responsible bidder for Drainage Improvement and Pavement Rehabilitation on Bailey
Court (SD04-14), per project Plan No. 11248. A contract is awarded accordingly to said bidder
in a total amount of 570,174.78, with a contingency amount of$10,299.00, but sLlch award shall
be effective only upon being fully executed by both parties. All other bids, theretore, are hereby
rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the
City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by
reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of passage oftheresolution.
