STAFF REPORT
SUBJECT
Resolution of the City of San Bernardino authorizing the obligation and expenditure of the
allocated FY 05/06 Justice Assistance Grant (JAG) funds and authorizing the signing of a multi-
jurisdiction JAG grant Memorandum of Understanding with the County of San Bernardino.
BACKGROUND
Over the past nine years, the Police Department has been the recipient of the Local Law
Enforcement Block Grant (LLEBG) that provided the department with federal funding for law
enforcement support expenditures. In FY 04/05 the Police Department received $152,888 in
LLEBG funding, which left a shortfall of approximately $204,257 needed to continue the
following grant programs previously funded in FY 03/04.
. Salary and benefits for one (1) ID Bureau supervisor
. Salary and benefits for three (3) police dispatchers
. Salary and benefits for two (2) Information Services analysts
. Total costs of the Crime Free Rental Housing Program.
In order to offset this shortfall, the Asset Forfeiture Fund picked up $76,000 in computer costs
originally budgeted in the Information Services Department so the Information Services
Department could fund the cost of one of the IS Analyst previously paid for with LLEBG funds.
The remaining shortfall of $128,300 will be covered with projected savings in booking fees
resulting from a negotiated settlement with the County of San Bernardino that is anticipated prior
to the end ofFY 04/05.
At President Bush's request, Congress consolidated the Byrne Grants and LLEBG into a single
program known as the Edward Byrne Memorial Justice Assistance Grant (JAG) in order to
streamline funding and grant administration. The following new JAG guidelines have been
implemented that change the grant application, funding formulas and grant administration
processes.

. JAG funds are split 60-40%, with 60% going to the State of California for the Edward
Byrne Memorial grants administered by the Office of Emergency Services. The
remaining 40% go to local law enforcement agencies as grant funds formerly known
as the Local Law enforcement Block Grant.
. One aggregate grant application for all JAG funds allocated to county law
enforcement agencies must be filed with the Bureau of Justice Assistance. The
application is due to the Bureau of Justice Assistance no later than March 31, 2005.
. One jurisdiction in the county must act as the grant administrator and fiscal agent for
JAG funds and may charge an administrative fee for performing these duties.
. The mandatory 10% grant match has been eliminated.
. The public hearing and advisory board requirements have been eliminated.

. A Memorandum of Understanding concerning the JAG program must be signed by all
jurisdictions in the County and must accompany the grant application.
The County Law & Justice Group has agreed to serve as the grant administrator and fiscal agent
for JAG program funds and will charge each recipient a 5% administrative fee. The County of
San Bernardino has prepared a multi-jurisdiction Memorandum of Understanding between the
cities within San Bernardino County and the County of San Bernardino, identifying the County Law
& Justice Group as the grant administrator and fiscal agent, and detailing JAG grant administration
and billing procedures. Each jurisdiction's Oty Manager/Administrator, Oty Attorney, and Oty
Oerk must sign the MOU.
For FY 05/06, the Police Department's allocation after deducting the 5% administrative fee is
$245,615. This amount is $92,727 more than last year's LLEBG allocation.
FINANCIAL IMPACT
The Chief of Police has determined the critical needs of the Police Department for FY 05/06 that
are described in the attached FY 05/06 JAG line item budget and budget narrative. The
department will be using the JAG allocation to fund the personnel costs of four (4) full-time
police civilian positions. The civilian positions are existing and filled.
RECOMMENDATION
Adopt resolution.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNOL OF THE
OTY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Mayor and Common Council of the Gty of San Bernardino are hereby
authorized to obligate and expend the allocated Justice Assistance Grant monies in the amount of
$245,615 from the U.S. Department of Justice and Bureau of Justice Assistance for law
enforcement support expenditures as outlined in the attached Expenditure Plan submitted by the
allef of Police (Exhibit" A").
SECTION 2.
The Mayor and Common Council of the Gty of San Bernardino hereby

Expenditure Plan Narrative
In Bureau Supervisor
The need for an on-site supervisor (Forensic Specialist III) was identified in an independent audit
of the Property Room conducted in August 1998. Since FY 99/00 this position has been funded
by LLEBG funds. In FY 03/04, the Forensic Specialist III position funded by the General Fund
and assigned to the ill Bureau was eliminated due to budget cuts. The remaining Forensic
Specialist III now supervises both units.
We need to maintain the current level of staffing and supervision in the Property and Evidence
facility and ill Bureau to provide adequate staffing to collect, process, store, and safeguard
property and evidence in police custody and protect the department and City from liability
arising from the mishandling or loss of these items. Maintaining this position will provide
additional safeguards to minimize the City's exposure to liability in this critical area of police
operations. For FY 05/06, the salary and benefits of the Forensic Specialist III will be $69,891.
Additional Dispatchers
In 2003, the Police Dispatch Center handled more than 500,000 telephone calls, including
138,089 calls on 9-1-1 lines. From these calls, a total of 109,317 resulted in a police response to
calls for service from the public. This workload makes the dispatch center one of the busiest
centers servicing medium sized cities. Since FY 99/00, LLEBG funding has been used to
augment their staffing, providing funding for three additional dispatcher positions. In January
2005, the Police Department will implement Split Frequency Dispatching, utilizing two primary
dispatch channels during peak periods for calls for service. These positions are essential to
maintain quality service for the public and department personnel and handle 9-1-1 calls and other
calls for police service. For FY 05/06, the salary and benefits of the three grant funded
Dispatcher II's will be $146,849.
Police Equipment
The remaining $28,875 in JAG funds will be spent for police safety equipment needed to support
department operations and not funded through the General Fund due to budgetary constraints.
These items would include Handie- Talkie (HT) radios, digital recorders, pursuit spike strips and
SW AT equipment.

INTERLOCAL AGREEMENT
BETWEEN THE TOWN OF APPLE VALLEY AND THE CITIES OF ADELANTO, BARSTOW,
CHINO, COLTON, FONTANA, HESPERIA, HIGHLAND, MONTCLAIR, ONTARIO,
RANCHO CUCAMONGA, REDLANDS, RIAL TO, SAN BERNARDINO, UPLAND,
VICTORVILLE, AND THE COUNTY OF SAN BERNARDINO, CA
CONCERNING DISTRIBUTION OF THE
2005 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD
This Agreement is made and entered into this. day of , 2005, by and
between THE COUNTY OF SAN BERNARDINO, acting by and through its governing body,
the Board of Supervisors (hereinafter referred to as "COUNTY"), and the aforementioned
TOWN (hereinafter referred to as "TOWN") and named CITIES (hereinafter referred to as
"CITIES"), acting by and through their respective governing bodies, the Town Council and City
Councils, all of whom are situated within the County of San Bernardino County, State of
California, as follows:
WHEREAS, each governing body, in performing governmental functions or in paying for
the performance of governmental functions hereunder, shall make that performance or those
payments from current revenues legally available to that party; and
WHEREAS, each governing body finds that the performance of this Agreement is in the
best interests of all parties, that the undertaking will benefit the public, and that the division of
costs fairly compensates the performing party for the services or functions under this
Agreement; and
WHEREAS, the COUNTY agrees to release to TOWN and CITIES their respective
grant allocation from the JAG Award within sixty (60) days upon receipt of funds, less five
percent (5%) for administrative-fees. as reflected on Appendix 1 here attached and hereby
incorporated by reference as part of this agreement; and COUNTY agrees to use the five
percent (5%) of JAG award funds received from TOWN and CITIES under this agreement for
administrative fees toward the administration of TOWN's and CITIES' programs during the
entire permissible duration of said programs; and TOWN and CITIES agree to deposittheir
JAG award funds into a separate trust account in accordance with JAG guidelines; and TOWN
and CITIES each agree to the five percent (5%) reduction of their respective grant allocation
from the JAG award, as reflected on Appendix 1 for administrative fees toward the
administration of this program; and additionally the TOWN and CITIES each agree that it is
their responsibility to ensure these funds are expended in accordance with JAG guidelines,
and that the interest generated from such funds shall be solely applied and expended in
accordance with these same JAG guidelines; and
WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate
the JAG funds,

Nothing in the performance of this Agreement shall impose any liability for claims or actions
against COUNTY other than what is authorized by law.
Section 5.
Nothing in the performance of this Agreement shall impose any liability for claims oracttolTs
against TOWN and/or CITIES other than what is authorized bX law.
Section 6.
Each party to this Agreement will be responsible for its own actions in providing services under
this Agreementandshallnalbaliable far any civil liability that may arise from the furnishing of
the services by any other party.
Section 7.
The parties to this Agreement do not intend for any third party to obtain a right by virtue of this
Agreement.

Section 8.
By entering into this Agreement. the parties do not intend to create any obligations, either
express or implied, other than those set out herein; further, this Agreement shall not create any
rights in any party not a signatory hereto.
