Synopsis of Previous Council Action:
5/17/04: Resolution #2004-135 was adopted calling a Special Municipal Election on a
Proposed City Charter and requesting that said election be consolidated with the
November 2, 2004 Statewide Presidential General Election conducted by the County of
San Bernardino. Resolution #2004-136 proposed a new City Charter and #2004-137
submitted to the qualified electors a proposed new City Charter
12/06/04: Resolution #2004-379 was adopted reciting the facts of the Special Municipal
Election held on November 2, 2004 and declaring the results thereof.

Resolution Reciting the facts of the Special Municipal Election held
on 11/2104 and directing the City Clerk to file the new City Charter
with the Secretary of State and the County Recorder's Office

BACKGROUND
The County Recorder's Office has requested that the Mayor and Common"Council
Adopt a Resolution to accompany the recently-approved new City Charter that has been
submitted for filing with the County Recorder's Office.
Pursuant to Government Code Section 34460, on December 20, 2004 the City Clerk's
Office transmitted to the Secretary of State and to the County Auditor-
Controller/Recorder a certified copy of the complete text of the new City Charter for
filing with both offices. In addition, certified copies of the following documents were
also transmitted:
1. Resolution #2004-135 - "Resolution ... calling a Special Municipal
Election On A Proposed New City Charter and Requesting That Said City
of San Bernardino's Special Municipal Election Be Consolidated With The
November 2, 2004 Statewide Presidential General Election Conducted By
The County of San Bernardino"
2. Resolution #2004-136 - "Resolution ...Proposing A New City Charter"
3. Resolution $2004-137 - "Resolution ... Submitting To The Qualified
Electors ... A Proposed New City Charter; Transmission Of The Proposed
... Charter To The Office Of The City Attorney For Purposes Of
Preparation Of An Impartial Analysis"
4. Proof of Publication Notice (English and Spanish Copies)
5. Certified copy of the argument filed in favor of Measure "G"
6. Resolution #2004-379 - "Resolution ...Reciting The Facts Of The Special
Municipal Election Held On The 2nd Day of November 2004, Declaring the
Results Thereof... "
On February 22, 2005, the City Clerk received a telephone call from Dana Boeg of the
County Recorder's Office requesting that the Mayor and Council adopt a Resolution to
accompany the full text of the recently-approved new City Charter.
Although Resolution No. 2004-135 did include, as Exhibit A, a copy of the proposed
new charter, that copy did not include the full text of the Charter. As noted in the first

paragraph, a certified copy of the full text of the newly-approved Charter was submitted
for filing with the County Recorder; however, it was not accompanied by a Resolution
approved by the Mayor and Common Council.
In accordance with the request of the County Recorder, it is hereby requested that the
Mayor and Common Council adopt the attached Resolution that recites the facts of the
Special Municipal Election held on November 2, 2004 and directs the City Clerk to file <
the full text of the new City Charter with the Secretary of State and the County
Recorder's Office.

CHARTER WITH mE SECRETARY OF STATE AND THE COUNTY. RECORDER.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
WHEREAS, On May 17, 2004, the Mayor and Common Council of the City of
San Bernardino adopted Resolution No. 2004-135 calling a Special Municipal Election on
a proposed new City Charter and requesting that said Special Municipal Election be
consolidated with the November 2, 2004 Statewide Presidential General Election
conducted by the County of San Bernardino; and
WHEREAS, notice of said election was duly and regularly given in the time, form
and manner as provided by law; voting precincts were properly established; election
officers were appointed and in all respects said election was held and the returns made
and declared in the time, form, and manner as required by the provisions of the Charter
of the City of San Bernardino and the Elections Code of the State of California for the
holding of public elections in the City of San Bernardino; and
WHEREAS, pursuant to Resolution Nos. 2004-135, 2004-136, and 2004-137,
adopted on May 17, 2004, the Registrar of Voters of the County of San Bernardino
canvassed the returns of said election and has certified the results to this City Council;
and
WHEREAS, said Special Municipal Election was held to allow voters to vote on
Measure G, a proposed new City Charter; and

MUNIICPAL ELECTION HELD ON THE 2ND DAY OF NOVEMBER 2004 AND
DIRECTING THE CITY CLERK TO FILE A CERTIFIED COpy OF THE NEWL Y-
ADOPTED CITY CHARTER WITH THE SECRETARY OF STATE AND THE
COUNTY RECORDER.
WHEREAS, the total of all votes cast on Measure G in said election was 37,547
including 9,840 absent voter ballots (out of a total of all votes cast in the Presidential
General Election of 43,053 including 11,275 absent voter ballots); and
WHEREAS, The Statement of the Results of the Special Municipal Election is
attached as Exhibit A and shows that the electors approved the proposed new City
Charter;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of
the City of San Bernardino that the- City Clet"k is- hereby directed to transmit to the
Secretary of State and to the County Recorder of the County of San Bernardino a
certified copy of the full text of the City Charter approved at the November 2, 2004
Special Municipal Election and that said City Charter be filed in accordance with
Government Code Section 34460.
