APPROVED 2005 MEADOWBROOK SINGLE FAMILY RESIDENTIAL DISPOSITION AND DEVELOPMENT AGREEMENT DATE: February 7, 2005 Synopsis of Previous Commission/Council/Committee Action(s): On December 9, 2004, Redevelopment Committee Members Estrada and McGinnis unanimously voted to recommend that the Community Development Commission consider this action for approval. On December 20, 2004, the Mayor and Common Council directed Staff to prepare the Disposition and Development of Agency Lot by Meadowbrook Park Homes, Inc., for consideration and approval. On January 10,2005, the Mayor and Common Council and the Community Development Commission jointly approved the 2005 Meadowbrook Single Family Disposition and Development Agreement by and between the Redevelopment Agency of the City of San Bernardino and Meadowbrook Park Homes, Inc. ("2005 Agreement"). APPROVED 2005 MEADOWBROOK SINGLE FAMILY RESIDENTIAL DISPOSITION AND DEVELOPMENT AGREEMENT BACKGROUND: In order to continue revitalizing the Meadowbrook Neighborhood, the Community Development Commission (the "Commission") approved the Meadowbrook Single Family Residential Grant Development Agreement (the "2003 Agreement") with ANR Industries, Inc, in February 2003. The 2003 Agreement was focused on the development of 23 new single-family homes. These new homes were constructed on 22 parcels owned by ANR, and on one (1) parcel owned by the Agency within an area bounded by 2nd Street on the north and Rialto Avenue on the south, Sierra Way on the west and Allen Street on the east ("Phase I Project"). Pursuant to the 2003 Agreement, the Agency provided ANR with a grant of Agency "Low- and Moderate- Income Housing Funds" in the amount of $500,000 to insure that ten (10) of the 23 new homes in the Phase I Project will be affordable and available for purchase by households with annual income of up to 120% of County median household income. Subsequent to the approval of the 2003 Agreement, the Commission authorized the Agency and the City of San Bernardino Housing Authority (the "Authority"), to enter into a cooperation agreement and to acquire up to eight (8) additional parcels of land in the Meadowbrook Neighborhood as part of "Phase IA Project" to further expand the supply of new single family homes available at affordable prices to Moderate-Income families as defined in the approved 2005 Agreement. Phase IA Project Area boundary extends the existing boundary to Waterman Avenue on the east from Allen Street. These additional parcels are referred to as the "Agency Lots" and are in escrow to be transferred to Meadowbrook Park Homes, Inc. for construction of eight (8) new homes. At the January 10, 2005 public hearing, the Mayor and Common Council and Commission were informed that as Agency concludes further acquisition through negotiated sales, those parcels acquired will be brought forward for disposition to the Developer. CURRENT ISSUES: The Agency has concluded negotiations and has acquired the property located at 188 North Allen Street (APN: 0135-291-17) (the "Property") for $148,000, and will clear the Property for an estimated cost of $10,000 and wishes to transfer it to the Developer for the construction of one additional single family home under the approved 2005 Agreement. The disposition of this Agency Lot is the subject of this joint public hearing. Meadowbrook Park Homes, Inc. (the "Developer") is a housing development entity related to ANR Industries, Inc., and the Developer proposes to continue the very solid start made under the 2003 Agreement to restore the Meadowbrook Neighborhood as a single family home community. Allen St. Page 2 The Developer is currently in escrow to purchase the eight (8) Agency Lots approved on January 10, 2005 and will develop them with New Homes similar in size and design with the other New Homes currently under construction in the Phase I Project. The Developer has agreed to acquire the Agency Lot located at 188 North Allen Street in accordance with the approved 2005 Meadowbrook Single Family Residential Disposition and Development Agreement (Meadowbrook neighborhood Restoration Area) (the "2005 Agreement"). It is proposed that Agency Lot be sold to the Developer for the development of an affordable new home (reserved for occupancy by a Moderate-Income Household earning up to 120% of County median income). For the purpose of the Health and Safety Code Section 33433 Report (described below as the "Summary Report"), the report includes only one (1) Agency Lot. The approved 2005 Agreement sets forth the terms and conditions under which the Agency Lot will be transferred to the Developer for development and sale of the New Home. The Developer shall pay the Agency the sum of $30,000 for the Agency Lot. This $30,000 will be used to offset the Agency direct subsidy costs of $158,000. The Developer must acquire Agency Lot in an AS IS condition, The payment by the Developer for the Agency Lot shall be evidenced by a promissory note secured by a subordinate deed of trust to a construction loan on the Agency Lot. The promissory note is payable by the Developer at the time of sale of the Agency Lot to a "Qualified Homebuyer". No interest accrues on the promissory note during the first eighteen (18) months, but after that date, the rate of interest is 6% per annum until paid. The Developer shall construct single family home on Agency Lot that is similar in size and design with DP III No. 03-34, as approved by the Planning Commission on November 18, 2003 for the Phase I Project. The Development of the New Home is expected to begin thirty (30) days after the Agency/Developer have closed escrow on the Agency Lot, and expected to be completed within twelve (12) months. Prior to the proposed sale of the Agency Lot to the Developer, the Commission, and Council are required to conduct a public hearing in accordance with Health and Safety Code Section 33433. The Summary Report identifies the salient points of the Disposition of Agency Lot pursuant to the approved 2005 Agreement, the cost of the sale of the Agency Lot to the Developer and the estimated value of the interests conveyed in the Agency Lot determined at the highest and best use permitted based on the restricted reuse value and the CC&R's which are part of the approved 2005 Agreement. As required under the Health and Safety Code Section 33433, a public notice of this joint public hearing was published in the Sun Newspaper of February 7 and 14,2005. ENVIRONMENTAL IMPACT: The proposed disposition and development of Agency Lot described above is a categorically exempt project under the California Environmental Quality Act ("CEQA"). Accordingly, a Notice of Exemption for the 2005 Agreement was filed with the County Clerk on January 14, 2005. FISCAL IMPACT: The estimated expenditure related to the Agency Lot is approximately $158,000. This figure includes actual acquisition and estimated demolition costs. SUMMARY REPORT PURSUANT TO HEALTH AND SAFETY CODE SECTION 33433 OF THE CALIFORNIA COMMUNITY REDEVELOPMENT LAW - REGARDING THE DEVELOPMENT AND DISPOSITION OF AGENCY OWNED PROPERTY AT 188 NORTH ALLEN STREET PURSUANT TO THE TERMS OF THE APPROVED 2005 MEADOWBROOK SINGLE-FAMILY RESIDENTIAL DISPOSITION AND DEVELOPMENT AGREEMENT BY AND BETWEEN THE REDEVELOPMENT AGENCY AND MEADOWBROOK PARK HOMES, INC., IN THE MEADOWBROOK NEIGHBORHOOD INTRODUCTION This Summary Report (the "Report") has been prepared by the Redevelopment Agency of the City of San Bernardino (the "Agency") in accordance with Health and Safety Code Section 33433. This Report sets forth certain details of the approved 2005 Meadowbrook Single-Family Residential Disposition and Development Agreement (the "2005 Agreement") dated January 10, 2005, by and between Meadowbrook Park Homes, Inc., a California corporation (the "Developer") and the Agency. The 2005 Agreement provides for the disposition of certain Agency-owned lands to the Developer for redevelopment as new single-family dwellings. The new housing development project, which may be undertaken by the Developer, is referred to in the 2005 Agreement as the "Project". In other written reports and materials relating to the Project: the new housing development activities of the Developer are also referred to as the "Phase IA Project". Per the 2005 Agreement, eight properties and other future Agency owned properties would be transferred to the Developer tor development into single-family homes. This report is prepared for the transfer of the 188 North Allen Street (APN: 0135-291-17) property (the "Property"). The purpose of the approved 2005 Agreement is to facilitate the development of single-family homes ("New Homes") in the Meadowbrook Neighborhood. Each such New Home will have three to four bedrooms and a" attached 2-car garage containing approximately between 1,500-1,850 square feet of interior living area. All necessary infrastructure improvements such as electricity, sewers, gutter, landscaping wiII be provided by the Developer. The exterior elevations of the New Homes will vary but in general, all elevations and floor plans will be similar to the other new homes being constructed nearby by ANR Industries, Inc, under Phase I. B. COST OF THE TRANSFER OF PROPERTY PURSUANT TO THE APPROVED 2005 AGREEMENT TO THE AGENCY This. Section outlines the total costs of transferring the Property to the Developer, including, but not limited to land acquisition and clearance costs. As stated above, the Agency has expended $158,000 for Property acquisition and estimated demolition of the structure on 188 North Allen Street (Agency Lot). The Agency wiII transfer the Agency Lot to the Developer for the construction of a single family home in order to provide affordable housing opportunities to moderate-income households. The Developer wiII pay $30,000 for the Agency Lot. The payment by the Developer for the Agency Lot shaII be evidenced by a promissory note secured by a subordinate deed of trust to a construction loan on the Agency Lot. The promissory note is payable by the Developer at the time the Developer selIs the Agency Lot to a "Qualified Homebuyer". No interest accrues on the promissory note during the first eighteen (18) months for the Agency Lot; after that date, the rate of interest is 6% per annum until paid. C. ESTIMATED VALUE OF THE INTEREST TO BE CONVEYED BY THE AGENCY DETERMINED ATTH~ HIGHEST AND BEST USES PERMITTED lJNBD;lBB RE~JljVELO!mW PLAN: AND ESTIMATED VALUE OF THE INTEREST TO BE CONVEYED BASED ON ~OUIRED REUSE AND WITH THE CONDITIONS. COVENANTS AND RESTRIctIONS REOUlRED The estimated value of Agency Lot is $30,000. The value was established through affordability analysis of cost supported by comparable sales in the area. The sale of the Agency Lot is necessary to facilir,te the implementation of the Redevelopment Plan for the Inland Valley Redevelopment Project Area (IVDA), which obligates the Agency to insure that affordable housing opportunities are made available to aII project area residents. In conclusion, the interest to be conveyed to Developer has been determined to be the highest and. best use- permitted under the IVDA Redevelopment Plan and holds true for die' muse value, considering that Agency Lot is subject to conditions, covenants and restrictions placed by the Agency per the approved 2005 Agreement. The interest and land conveyed to the Developer will be developed in conformance with the City's General Plan and Housing Element, Municipal Development Code, and Agency's AB 1290 Implementation Plan. .
