Staff Report
SUBJECT:
Resolution amending Resolution No. 2005-2, changing the public meeting date from February
21,2005 to February 22,2005 (Assessment District No. 1036 - Tract No. 16509).
BACKGROUND:
On January 10, 2005, Resolution of Intention No. 2005-2, relative to the formation of
Assessment District No. 1036 in the Campus Parkway and Northpark Boulevard area, was
adopted. The Resolution also set a public meeting date of February 21, 2005 and a public hearing
date of March 7, 2005. Notice was sent to the property owner on January 12,2005.
Since the public meeting date of February 21, 2005 is a holiday, the date of February 22, 2005
needs to be set.
The attached resolution amends Resolution No. 2005-2 to reflect a change in the meeting date.
The property is currently still under one ownership, and an amended notice was sent to the owner
to advise of the change in the meeting date. The amended notice was mailed on January 20,
2005, in order to meet the 45 day notice as required by law.
FINANCIAL IMPACT:
None.
RECOMMENDATION:
Adopt Resolution.
Urgency Clause: It is necessary to adopt the resolution at the 1/24/2005 Council meeting in
order to comply with the notice timing requirements for the March 7, 2005 public hearing.
An additional two week delay would also require a new public hearing date in order to
meet the legal 45 day notice requirement, and would result in additional costs and delays in
completing the formation prior to properties in the district being sold.

NECESSITY REQUIRE THE FORMATION OF A MAINTENANCE ASSESSMENT
DISTRICT LOCATED IN THE NORTHPARK BOULEVARD AND CAMPUS PARKWAY
AREA...TO BE KNOWN AS ASSESSMENT DISTRICT NO.I036..."AND CHANGING
THE PUBLIC MEETING DATE FROM FEBRUARY 21, 2005 TO FEBRUARY 22,2005.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. On January 10,2005, the Mayor and Common Council adopted Resolution
No. 2005-2, entitled:
"RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY
DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE
THE FORMATION OF A MAINTENANCE ASSESSMENT DISTRICT LOCATED IN
THE NORTHPARK BOULEVARD AND CAMPUS PARKWAY AREA WITHOUT
COMPLIANCE WITH THE SPECIAL ASSESSMENT INVESTIGATION, LIMITATION
AND MAJORITY PROTEST ACT OF 1931; DECLARING ITS INTENTION TO
PROCEED TO ORDER WORK WITHIN THE DISTRICT, TO BE KNOWN AS
ASSESSMENT DISTRICT NO. 1036; PRELIMINARILY APPROVING THE
ENGINEER'S REPORT AND GIVING NOTICE OF A PUBLIC MEETING AND PUBLIC
HEARING."
Resolution No. 2005-2 erroneously set the public meeting on Monday, February 21,2005,
at the hour of 4:00 p.m. February 21,2005 is President's Day, a national and state holiday. This
Resolution changes the date of the public meeting to Tuesday, February 22,2005.
SECTION 2. Section 6 of Resolution No. 2005-2 is hereby amended to change the public
meeting date from February 21, 2005 to February 22,2005, at the hour of 4:00 p.m.
