Baclmround: Due to intense rains during early January, some damage occurred throughout the City to storm drain channels, debris basins, and to City streets. In the event that State or Federal funding becomes available to reimburse the City for costs incurred as a result of the storm, it was necessary to proclaim the existence of a local emergency within seven (7) days of the incident. The proclamation also provides support to the Governor's request for a Presidential Declaration. Staff is in the process of estimating damage costs. Once that information is available it will be forwarded to the Mayor and Council. Fiscal Impact: None. EXHIBIT" A" o PROCLAMATION OF THE CITY OF SAN BERNARDINO DECLARING THE EXISTENCE OF A LOCAL EMERGENCY WHEREAS, Chapter 2.46 of the Municipal Code of the City of San Bernardino empowers the Mayor to proclaim the existence or threatened existence of a local emergency when said City is affected or likely to be affected by a public calamity and the Common Council is not in session; and WHEREAS, at the time ofthe issuance of this Proclamation, the Mayor and Common Council are not in session, therefore, the undersigned, as Mayor of the City of San Bernardino do hereby find that conditions of peril to the safety of persons or property have arisen within the City of San Bernardino caused by intense rains, including damage o to storm drain channels, infrastructure, building structures, and from the accumulation of debris within roadways at multiple locations; and WHEREAS, the aforesaid conditions of peril warrant and necessitate this proclamation of a Local Emergency; NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a local emergency now exists throughout said City commencing on or about 9:00 a.m. on January 7, 2005; and IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said local emergency the powers, functions, and duties of the emergency organization of this City shall be those prescribed by state law, by ordinances, and resolutions of this City, and by the City of San Bernardino Emergency Plan. o _ =,~"o>">, " o o " ~-, - ->'''~'-=~ '.~r~ " .V"'"""'" IT IS FURTHER PROCLAIMED AND ORDERED that the Common Council shall ratify this proclamation within seven (7) days of the issuance of this Proclamation.
