RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO OPPOSING THE ISSUANCE OF AN ALCOHOL BEVERAGE CONTROL LICENSE TO THE NEW SAN MANUEL INDIAN BINGO AND CASINO LOCATED AT 777 SAN MANUEL BOULEVARD IN THE CITY OF SAN BERNARDINO. WHEREAS, the newly constructed San Manuel Indian Bingo and Casino, located at 777 San Manuel Boulevard with a mailing address of Highland, California, 92346, hereinafter referred to as "CASINO", resides adjacent to the legal boundaries of the City of San Bernardino on property that was zoned for residential use; and WHEREAS, CASINO is adjacent to the jurisdiction of the City of San Bernardino Police Department and the City is legally obligated to enforce the Laws of the State of California as to any and all persons entering and leaving CASINO premises; and WHEREAS, CASINO is surrounded by residential neighborhoods, schools, and churches; and WHEREAS, according to the Environmental Assessment prepared by the San Manuel Tribe, CASINO is anticipated to produce an additional 17,000 new vehicle trips per day; and WHEREAS, CASINO patrons' only avenue of ingress and egress is on two residential streets on which residents and students must travel in order to access their homes and schools and precludes any reasonably safe mitigation for either its patrons or local residents; and WHEREAS, the original purpose for the property on which CASINO is located was presented to the City of San Bernardino, County of San Bernardino, and the Bureau of Indian Affairs in the Tribes application to transfer said property into Fee for Trust as park and recreational use, not Indian Gaming or the consumption of alcohol; and WHEREAS, prior to 2001, the Tribe stated in public meetings that the existing Casino would never serve alcohol to its patrons; and WHEREAS, the existing 125,000 square foot casino cu No, 2.1 C2M~PLt ) 1/ (J J 0) excessive noise from traffic and emergency vehicles, vagrancy, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 .--,- -- for prostitution, off-site drunkenness, littering, and other negative impacts within the residential community and the 460,000 square foot CASINO will severely increase such activity; and WHEREAS, the City of San Bernardino was not officially notified of the request by the San Manuel Indian Bingo and Casino for a Department of Alcoholic Beverage Control license by either the San Manuel Tribe or the California Department of Alcoholic Beverage Control. NOW, THEREFORE be it resolved by the Mayor and Common Council of the City of San Bernardino that the City of San Bernardino opposes the proposed alcohol beverage control license for the new San Manuel Indian Bingo and Casino and demands that the application for said license be rejected for the reasons cited in this resolution.
